초록
제2의 인터넷 혁명이라고 불리는 블록체인은 기존의 정보의 인터넷에서 투명성과 신뢰성이 업그레이드된 가치의 인터넷으로 발전되고 있다. 인터넷 기업이 21세기에 등장하여 기존 굴뚝 기업들을 물리친 것처럼 시장에서는 블록체인의 등장이 새로운 패러다임 시프트(paradigm shift)가 될 것이라고 예상한다. 블록체인 기술은 국제무역, 물류, 항공 산업 등에 많은 변화를 줄 수 있는 기술이다. 세계 경제는 디지털 사회로 진행되고 있으며 그 중심에 블록체인 기술이 자리 잡고 있다. 블록체인이란 상품이나 금전 등의 거래 이력 데이터를 블록으로 집약하고 체인으로 연결하여 각 노드에 분산된 분산원장을 말한다. 블록체인 기술은 분산원장을 통하여 정부기관이나 은행 등 거래의 신뢰를 담보하는 기존의 중앙 집중형 네트워크 기반의 인프라를 뛰어 넘어 높은 확장성, 보안성, 투명성 등을 보장할 수 있다. 블록체인 기술은 초기에는 비트코인의 원천기술로서 발전되어 왔지만 지금은 비트코인 이외에도 수많은 분야에 적용할 수 있는 가능성을 지닌 기술로서 평가된다. 국제무역의 경우 코인으로 송금하여 은행에 수수료를 내지 않아도 되고, 해외에 상품을 수출할 때 원산지로부터 선적, 운송, 통관 과정이 블록체인에 의하여 실시간 기록되어 물류비용을 절감할 수도 있을 것이다. 디지털 서명을 통하여 공공분야, 의료시스템, 보험계약 등에도 응용될 수 있을 것이라고 예측된다. 블록체인 기술이 미래의 사회에 얼마나 확장성을 가진 기술로서 항공 산업, 물류산업 등에서 많은 혁신적인 기술이다. 블록체인의 디지털 작업을 통한 항공 산업과 물류데이터의 표준화와 투명성, 업무 간소화 및 고객 서비스 확대할 수 있는 계기가 될 수 있을 것으로 기대된다. 블록체인이나 스마트계약 등은 4차 산업 시대의 새로운 개념이다. 이들을 기존 법개념에 포함시킬 것인지 아니면 새로운 법제도의 틀을 새롭게 창조할 것인지를 정해야 할 것이다. 과거에 산업에 적용되었던 기존의 법규를 가지고 블록체인과 같은 신사업을 규제할 수 없다. 일정기간동안 기존의 규제를 면제 또는 유예시켜주는 규제 샌드박스 등의 도입 등으로 과도한 규제가 신사업 기회를 방해해서는 안 될 것이다. 우리도 블록체인 등 미래 산업에 대한 과도한 규제를 철폐하고 법적으로 관련 산업이 건강하게 운영될 수 있도록 건강한 생태계를 만들어야 한다.
Abstract
The blockchain, called the second Internet revolution, is evolving from the Internet of information to the Internet of value with improved transparency and reliability. Just as Internet companies emerged in the 21st century and defeated existing chimney companies, we expect blockchain to emerge as a new paradigm shift in the market. Blockchain technology is a technology that can make a lot of changes in the international trade, logistics, and aviation industries. The global economy is progressing into a digital society, with blockchain technology. Blockchain refers to a ledger distributed to each node by aggregating transaction history data such as commodities and money into blocks and connecting them in a chain. Blockchain technology can ensure high scalability, security, and transparency beyond the existing centralized network-based infrastructure that secures the trust of transactions such as government agencies and banks. Blockchain technology was initially developed as a source technology of Bitcoin, but now it is evaluated as a technology that can be applied to a number of fields besides Bitcoin. In the case of international trade, there is no need to pay a fee by remitting a coin based on blockchain, and when exporting goods overseas, shipment, transportation, and customs clearance procedures from the country of origin will be recorded by the blockchain in real time, thereby reducing logistics costs. Digital signatures are expected to be applicable to the public sector, health care systems and insurance contracts. How scalable blockchain technology is to the society of the future, it is an innovative technology in the aviation industry and logistics industry. It is expected that this will be an opportunity for standardizing and transparency in the aviation industry and logistics data through blockchain digital work. Blockchain and smart contracts are a new concept in the era of the fourth industry. It is necessary to decide whether to include them in existing legal concepts or to create a new legal framework. We can't regulate new businesses like blockchain with existing laws that have been applied to the industry in the past. Excessive regulation should not hinder new business opportunities. We need to introduce a regulatory sandbox that exempts or suspends existing regulation over a period of time. We also need to create a healthy ecosystem to abolish excessive regulation of future industries such as blockchain and to legally operate the relevant industries.
