불법 전단 옥외광고물에 대한 제재에 관한 연구

도시의 번화한 밤거리를 지나다보면 휘황찬란한 네온사인 간판들의 불빛들로 장관을 이루는 ‘야경’을 보게 된다. 이는 옥외광고물들로서 화려한 그 이면에는 ‘빛 공해’ 등과 같은 부정적인 요소도 많이 나타나고 있다. 특히 옥외광고물 중에서도 광고효과로 대량성과 신속성을 가진 일반형 전단지와 명함형 전단지는 번화가 지역의 주요 전철역, 버스정류장의 바닥, 교통신호기 심지어 가로수에까지도 무작위 살포되어 미간을 찌푸리게 하고 도시의 슬럼화 현상을 부추기게 한다. 이는 단순히 쓰레기나 미관의 문제만이 아니라 업체의 대부분이 대포폰을 사용하고 있고 청소년들에게 악영향을 미치는 불법, 음란광고 그리고 연이율 100%이상인 살인적인 금리 폭탄을 안기는 불법 대부업 광고가 대부분이라는 것이 더 문제이다. 게다가 최근에는 대학의 여학생 화장실에까지 여성도우미를 구한다는 내용의 불법전단 광고물이 무작위로 살포되고 있는 실정이다. 하지만 이러한 불법 전단을 사용하는 이유는 현재의 어려운 경제상황 속에서 상인들은 광고를 하지 않을 수 없는 상황에서 저렴하게 광고 할 수 있다는 것인데 법이나 규격에 맞지 않는 불법 전단으로 인하여 도시의 미관을 해치고 행정청의 단속에도 불구하고 그 개선이 미비하다. 또한 이에 따라 환경미화원들의 청소와 도시의 미관을 정비하는 비용도 만만치 않게 사용되고 있다. 따라서 전단의 정의와 불법 전단의 의미를 구분하여 비교하여 보고 전단 광고가 얼마나 소비자와 도시환경에 지대한 영향을 미치는지 분석하여 그 심각성을 분석하고자 한다. 또한 현행 이러한 여러 문제점들에 대해서 현행 제재 법제와 한계를 살펴보고 사회의 흐름에 역행 할 수도 있지만 현행 행정질서벌에서 행정형벌로의 전환, 살포자 및 사업주를 처벌하는 양벌규정의 강화, 불법 전단에 의해서 발생한 정비, 청소, 단속 등에 대한 사회적 정비비를 업체에 부담하도록 하는 제재 방안에 대해서 고찰해 보고자 한다.
