해운재건정책에 대한 법제도적 고찰 -한국해양진흥공사법을 중심으로-

한진해운의 파산으로 대표되는 우리나라 해운산업의 침체가 지속되고 있다. 이러한 해운산업의 경쟁력을 높이기 위해 지난 박근혜 정부는 「해운산업 경쟁력 강화 방안」과「해운업 금융지원 프로그램 추진현황 및 향후계획」을 발표하였다. 이러한 정책적 대응의 산물 가운데 하나가 한국선박해양의 설립이었다. 한편, 문재인 정부는 해운산업의 재건을 위해 「해운재건 5개년 계획(2018∼2022년)」을 발표하였다. 이러한 정책적 대응의 구체적 결과물이 한국해양진흥공사법의 제정과 한국해양진흥공사의 설립이었다. 특별히 해운산업에 특화된 금융회사의 설립은 해운업계의 오랜 숙원 사업이었다는 점에서 한국해양진흥공사의 설립은 해운산업의 재건을 위한 초석이 될 것으로 기대된다. 정부의 권한 분배의 관점에서 보면, 과거의 한국선박금융공사와 한국해양금융공사의 경우 기획재정부와 금융위원회가 정책적 주도권을 행사할 수밖에 없었다. 이에 반해 한국해양진흥공사는 해양수산부가 주된 감독기관이 되고, 금융위원회가 한국해양진흥공사의 경영건전성을 유지하기 위한 필요한 검사를 수행할 권한을 갖는 것으로 정리되었다. 다만, 한국해양진흥공사의 주된 업무가 금융업무라는 관점에서 보면, 기획재정부를 중심으로 한 금융전문가와 해양수산부를 중심으로 한 해운전문가가 동수로 이사회에 참여하는 지배구조를 모색할 필요성도 있었다고 본다.
Abstract
Hanjin Shipping, one of the world-famous shipping companies, was declared bankrupt in February 2017. As a result, the shipping industry in Korea has been much worse since then. The Ministry of Oceans and Fisheries(MOF) financially made an effort to assist the shipping industry. However, the MOF’s policy had not been effective in both 2016 and 2017. The new Government of 2017 tried to establish a public entity to support the shipping industry financially. The Government, therefore, submitted the draft bill of the Korea Ocean Business Corporation(KOBC) in August, 2017. Then, the bill passed by the National Assembly in December, 2017. Finally, the KOBC was officially established in July, 2018. According to the Korea Ocean Business Corporation Act, main task of the KOBC includes investment support, guarantee business, and so on. Especially, the investment support of the KOBC is ship owning business, shipbuilding investment, investment in ports and terminals and capital expansion.
