디자인의 유사성 판단에서, 물품의 ‘기능상 불가결한 형상’ 부분은 그 중요도를 낮게 평가하여야 할 필요가 있지만, ‘기능을 확보하는 데 필요한 형상’ 부분은 기능적 고려가 있다는 이유만으로 그 중요도 를 낮게 평가해서는 안 된다. ‘기능상 불가결한 형상’ 부분이라고 하여 유사성 판단에서 완전히 제거하고자 하는 것은 타당하지 않다. 이러한 형상 부분도 나머지 부 분과의 상관적인 관계에서 디자인의 전체적 시각적 효과에 영향을 미치는 것을 부인하기 어렵기 때문이다. 다만 선택 가능한 대체디자 인이 존재하지 않는 형상의 경우, 기술적 기능의 독점에 대한 우려가 있기 때문에 그 권리범위를 일부 제한할 필요가 있다. 이런 점에서 ‘기능상 불가결한 형상’ 부분은 디자인의 유사성 판단에서 그 중요도 를 낮게 평가하는 것이 타당하다. 반면에, ‘기능을 확보하는 데 필요한 형상’ 부분은 단지 기능적 고 려가 있다는 이유만으로 디자인의 유사성 판단에서 그 중요도를 낮 게 평가해서는 안 된다. 물품의 외관은 공지요소, 기능적인 요소, 심 미적인 요소, 새로운 창작적 요소 등 다양한 성격을 가진 여러 구성 요소들의 결합으로 이루어지게 된다. 이러한 요소들은 시각적인 면 에서 상호 관련성을 가지면서 그 전체적인 결합에 의하여 디자인 고 유의 심미감(인상)을 만들게 된다. 디자인권은 이러한 다양한 요소들이 결합된 전체적·시각적 효과를 보호하는 것이므로, 그 구성요소 중 의 일부에 기능적인 고려가 있었는지 여부는 중요하지 않다. 따라서 ‘기능상 불가결한 형상’이 아닌 단지 ‘기능을 확보하는 데 필요한 형 상’은, 디자인의 유사성 판단에서, 기능적 고려가 있다는 이유로 그 중요도를 낮게 평가해서는 안 된다.
Abstract
The features dictated solely by the technical function should be evaluated as having a low weight in comparing the substantial similarities of the design. However, design features that include just functional considerations should not be underestimated in weight. It is not reasonable to completely remove or ignore features dictated solely by the technical function from the similarity comparison of designs. The features dictated solely by the function can also affect the overall visual impression of the design in relation to other features of the design. However, if there is no alternative design, there is a concern about the monopoly on the technical function, so there is a need to limit the scope of the rights of those features. For this reason, it is reasonable to underestimate the importance of the features dictated solely by the technical function, in the comparison of the substantial similarity of the design. On the other hand, features that are merely related to functions should not underestimate the importance of those features, just because they have functional considerations. The appearance of a product consists of a combination of various components with well-known components, functional features, aesthetic elements, and new creative elements. These components are visually related to each other and create a unique aesthetic (impression) of the design by the overall combination of those elements. The design right protects the overall and visual effects of these various components, so it does not matter whether some of the components have functional considerations. Therefore, features that are related merely to a function, not features dictated solely by a technical function, should not underestimate their importance because they are merely functional considerations.
