이 글의 목적은 북한 손해배상법을 통해 북한 사회를 이해하는 데 있다. 북한이 비록 폐쇄적인 사회이기는 하지만 국가의 체계를 갖추고 있고, 그 안에서 다양한 거래와 사회활동이 이루어지고 있다. 북한에서도 손해배상과 관련한 다양한 분쟁이 발생할 수밖에 없고, 그 해결을 위한 기준과 원칙이 필요하다. 북한은 2000년대 들어 수많은 법령들을 제정 또는 개정하고 있는데, 그중에는 손해배상과 관련한 법령들도 많다. 북한법상 손해배상에 관한 기준과 원칙을 파악하는 것은 북한 사회를 좀 더 깊이 이해하는 데 도움을 줄 수 있다. 이 글에서는 북한 손해배상법과 관련한 5가지 쟁점을 중심으로 북한 사회를 이해해 보고자 한다. 첫 번째는, 북한의 집단주의원칙이 손해배상법의 기능과 지도원리에 있어서 어떠한 형태로 나타나고 있는지이다. 두 번째는, 북한이 2001년 「민법」과 별도로 「손해보상법」을 제정한 이유와 그 배경에 관한 것이다. 세 번째는, 북한 「행정처벌법」상 변상처벌제도가 무엇이고, 왜 북한에는 이러한 제도가 존재하는가이다. 네 번째는, 북한에 국가배상제도가 존재하는지, 존재하지 않는다면 그 이유는 무엇인지에 관한 것이다. 다섯 번째는, 북한에서는 손해를 어떻게 이해하고 있는지, 그리고 북한법상 정신적 손해에 대한 배상이 인정되는지 여부이다.
Abstract
The purpose of this study is to understand North Korean society through its compensation for damage law. Although North Korea is a closed society, it has a national system, and various transactions and social activities are taking place in it. Various disputes regarding compensation for damages will inevitably arise in North Korea, and standards and principles are needed to resolve them. In the 2000s, North Korea enacted or revised numerous statutes, many of which are related to compensation for damages. Identifying the criteria and principles of dispute settlement under North Korean compensation law can help understand North Korean society in a deeper way. In this article, I would like to understand North Korean society, focusing on five issues related to the North Korean compensation law. The first is how the North's Collectivism is represented in the guiding principles of its compensation law. The second is about the reason and background of North Korea's enactment of the Compensation for Damage Act, separate from the Civil Code in 2001. The third is, what the ‘변상처벌(Byunsang-Cheobeol, reimbursement penalty)' under North Korea's Administrative Punishment Act is, and why such a system exists in North Korea. The Fourth is, whether or not there is a state compensation system in North Korea, and why. The fifth is, how North Korea understands the concept of damage and whether compensation for mental damage is recognized in its law.
