국제형사재판소의 피해자 배상명령의 필수요소에 대한 검토
Study on Essential Elements of Reparations Order to Victims in the International Criminal Court

국제형사재판소(ICC)의 상소부는 루방가(Lubanga) 사건 상소심 판결에서 최초로 로마규정 제75조의 배상명령의 5가지 필수요소를 확립하였다. 즉 1) 배상명령은 유죄를 선고받은 자에 대해 내려져야 한다; 2) 유죄를 선고받은 자에게 명령서에 명시된 배상과 관련한 그의 책임을 확인하고 알려주어야 한다; 3) 배상유형(개인적 배상, 집단적 배상 또는 양자 모두에 대한 배상)을 특정하여야 하고 그 이유를 제시해야 한다; 4) 유죄가 선고된 범죄의 결과로 발생한 직접 및 간접 피해자에게 야기된 피해를 정의해야 할 뿐만 아니라, 특정 사건의 상황에 근거하여 재판소가 적절하다고 간주하는 배상 양식를 확인해야 한다; 5) 피해자들이 입은 피해와 유죄판결을 받은 범죄 사이의 연관성에 근거하여 배상금으로 혜택을 받을 수 있는 피해자를 확인하거나, 배상 적격 기준을 제시해야 한다. 이 논문은 이와 같은 배상명령의 필수요소에 대한 상소부 판결의 내용의 법리를 구체적으로 파악하고, 그것의 타당성을 검토하였는 바, 국제형사재판소의 재판부가 피해자 배상명령을 내릴 때 고려하여야 할 최소한의 요소를 로마규정과 절차 및 증거규칙의 관련 조문과 피해자배상에서의 재판부와 신탁기금의 역할분담을 고려하여 적절하게 제시하고 있다고 본다. 그러나 국제형사재판소의 피해자배상제도는 우리 법과는 기본적인 구도, 전제 상황 및 실무운영이 상당히 다르므로 ‘배상명령의 필수요소’가 우리 법의 배상명령판결에 대해서 시사하는 바는 별로 없다고 본다. 하지만, 국제형사재판소의 피해자배상명령의 집행과정은 최근 우리나라에서 문제가 되고 있는 일본군위안부와 일제강제동원 피해자에 대한 손해배상 판결의 집행과정에 대하여 시사하는 바가 있다고 본다.
Abstract
In the first appellate judgment on Trial Chamber I’s decision on reparations principles in Lubanga Case, the Appeals Chamber of ICC held that an order for reparations under 75 of the Rome Statute must contain, at a minimum, five essential elements: 1) it must be directed against the convicted person; 2) it must establish and inform the convicted person of his or her liability with respect to the reparations award in the order; 3) it must specify, and provide reasons for, the type of reparations ordered, either collective, individual or both, pursuant to rules 97(1) and 98 of the Rules of Procedure and Evidence; it must define the harm caused to direct and indirect victims as a result of the crimes for which the person was convicted, as well as identify the modalities of reparations that the Trial Chamber considers appropriate based on the circumstances of the specific case before it; and 5) it must identify the victims eligible to benefit from the awards for reparations or set out the criteria of eligibility based on the link between the harm suffered by the victims and the crimes for which the person was convicted. The purpose of this research is to grasp the judgment of the Appeals Chamber on five essential elements of reparations order and check its validity. The judgment of the Appeals Chamber suggests appropriately the essential elements of reparations order in the light of the relative provisions of Rome Statute and Rules of Procedure and Evidence, and the role allocation between the Trial Chamber and Trust Fund in the reparations to victims. As the basic structure, targeting situations and practices of the reparations to victims in ICC are very much different from our reparations order, the essential elements of reparations order has few implications for our reparations order. The implementation process of reparations order to victims in ICC has, however, some implications for the implementation the judgment of compensation for damages to compulsory mobilization victims during Japanese occupation.
