지방자치는 헌법적 보장의 대상이면서도 제도적 보장의 본질상 법률유보 하에서 보장되는 결과, 지방자치의 구체화는 법률에의 의존성이 매우 크다. 이를 법제도적으로 본다면, 지방자치의 성패는 지방자치와 관련하여 법률을 제정하는 국회, 법률을 집행하는 행정부 및 법률을 선언하고 해석하는 사법부의 인식과 태도에 크게 의존할 수밖에 없다. 지방자치의 헌법적 보장은 직접적으로는 지방자치단체에 대한 자치권의 보장을 내용으로 하지만, 그 이면으로는 국가에 대한 보장 및 보호의무를 내용으로 하는 점에서, 조례의 활성화에 대한 국가의 역할은 단순히 정책적 요청이 아니라 헌법적으로 요구되는 규범적 요청이다. 헌법은 단순한 규범이 아니며, 주권자에 의한 그 나라의 정치, 사회, 문화적 결단의 산물이다. 따라서 헌법이 보장하는 지방자치 및 조례제정권의 이상적 실현을 위해서는 조례의 본질에 대한 규범적 논의의 강조도 중요하지만, 그에 못지않게 조례제정권을 실질적으로 법제도화하는 국가권력에서의 규범적 인식의 전환이 우선되어야 한다. 국가의 행정권은 주로 지방자치단체에 대한 국가의 감독 및 통제를 통해 지방자치권과 관련되는바, 국가감독 및 통제의 문제는 기본적으로 국가와 지방자치단체의 관계 설정에서 비롯된다. 주지하다시피 지방자치단체는 규범적으로 국가와 대등한 협력관계에서 존재하는데 반해, 우리나라 지방자치의 현실은 규범적 원리와는 별개로 후견적 지방자치가 일반화되어 지방‘자치’가 아닌 지방‘행정’으로 인식되는 것이 정치・사회 일반의 인식이며, 이는 지방자치제도를 보장하고 보호하여야 하는 국가의 입법, 행정, 사법 역시 다르지 않다. 국가감독에 대한 현행 실정법제도 마찬가지로 국가우월적이고 후견적인 지방자치를 지방자치법제의 기본구조로 하고 있다고 보이며. 이는 조례제정권에 대한 과도한 통제와 감독을 통해 조례의 활성화를 저해하는 원인이 되고 있는바, 조례의 자주입법성에 대한 적극적 인식이 필요하다. 제도적 보장의 성격상 지방자치제도의 구체적 형성은 법률에 의존하게 되는바, 국가의 입법권은 조례의 활성화에 가장 직접적인 역할을 한다. 특히 제도적 보장에 대해서는 기본권보장과 달리 ‘최소한 보장의 원칙’이 적용되며, 따라서 법률에 의한 구체화에 있어서는 입법자에게 제도의 구체적 내용과 형태의 형성권이 광범위하게 인정되는 점에서, 조례제정권의 실질적 보장에 대한 1차적 책임은 입법권에 있다. 입법권을 통한 지방자치의 이상적 실현을 위해서는 조례의 준법률성에 대한 직접적 실현이 가장 바람직하지만, 현재 우리나라 지방자치의 수준 및 인식을 고려할 때, 조례제정권의 확대를 위한 가장 현실적인 입법적 접근은 조례에 대한 포괄적 위임의 확대이다. 그럼에도 우리나라 입법현실은 포괄적 위임에 매우 소극적인바, 조례의 법적 성질에 대한 과감한 인식의 전환이 요구된다. 사법권은 본질상 조례의 활성화와 직결되는 것은 아니지만, 지방자치에 대한 기본인식이 미흡한 결과에서 비롯된 현행 지방자치법제의 흠결 및 불충분성을 고려하면, 그러한 법을 집행하는 행정권 및 법을 해석하고 선언하는 사법권의 역할 또한 입법 못지않게 중요하다. 그럼에도 불구하고 우리나라 현행 사법실무의 입장은 지방자치와 관련하여서는 지나치게 실정법에 충실한 나머지 입법의 문언적 한계를 뛰어넘고 있지 못하며, 그러한 의지와 인식도 부족한 것으로 보인다. 지방자치 관련 법령의 해석에 있어서는 문언의 문리적 해석이 모호한 경우 헌법의 이념을 구체화하는 적극적 법해석이 필요하며, 특히 우리나라의 현행 헌법은 지방자치와 관련하여 극히 추상적이고 간략한 규정만을 두고 있음을 고려할 때, 사법적극주의적 해석을 통하여 헌법의 이념 및 취지를 충분히 실현하는 헌법구체화적 법해석의 필요성이 더욱 크다고 할 것이다.
Abstract
Although local autonomy is directly guaranteed by the Constitution, local autonomy relies on the specification of the law in that its legal nature is institutional guarantee. As a result, in the legal system, the success or failure of local autonomy depends heavily on the perceptions and attitudes of the parliament that enacts laws related to local autonomy, the executive branch that enforces the law, and the judiciary department that declares and interprets the laws. In particular, the role of the state for the vitalization of local autonomy is very important in that local autonomy is not a product of a priori legal theory but a product of concrete experiences based on political, social and cultural experiences of each country. The constitutional guarantee of local autonomy is on the one hand the guarantee of autonomy to local governments, while on the other hand it states that the state has a duty to protect local autonomy. In that sense, the state's role in the activation of the ordinances is not just a policy requirement, but a constitutional demand. The Constitution is not just a norm; it is the product of a country's political, social, and cultural decision by the Sovereign. Therefore, in order to revitalize the local autonomy required by the Constitution, the change of the normative recognition of the state power that specifically institutionalizes the local autonomy should be prioritized. Judicially, local governments exist in equal partnership with the state. Nevertheless, the reality of local autonomy in Korea is different from the normative principle, guardian autonomy is common. As a result, the state's legislative, executive and judicial powers are regarded as local ‘administration’, not local ‘autonomy’ in the local autonomy system, generalizing state superior and guardian oversight and control over the ordinances. As a result of local autonomy embodied by law, the legislative power of the state plays the most direct role in the activation of ordinances. Therefore, in order to revitalize the ordinances, it is most desirable for the legislative power of state, which has the primary responsibility for the actual guarantee of of the ordinance-making power, to respect the the lawful nature of the ordinance as much as possible. However, considering the reality of local autonomy in Korea, the most realistic way is to make full use of comprehensive delegation. Nevertheless, Korea's legislative reality is very passive in comprehensive delegation, which is a major obstacle to the activation of ordinances. Jurisdiction is not directly related to the activation of bylaws, since the interpretation and declaration of the law is the main role. However, considering the flaw and insufficiency of laws related to local autonomy, the role of jurisdiction to compensate for the lack of such laws becomes very important. Nevertheless, the basic position of Korean jurisdiction is too dependent on the real law, so it is difficult to expect a function to expect a function that makes up for the lack of local government-related laws. In cases where local autonomy laws are flawed and ambiguous, active interpretation of the law, taking into account the ideology of the Constitution, is a natural responsibility of jurisdiction. The jurisdiction needs to shift from its passive position to a judicial activist attitude to fully realize the ideology and intent of the Constitution to guarantee local autonomy.
