항고소송에서 ‘분쟁의 1회적 해결 요청’과 상소의 이익

‘Request for One-Off Dispute Resolution’ in an Appeal Litigation and Benefit of Lawsuit

초록

항고소송에서 처분을 취소하여야 하는 위법사유에는 다양한 종류가 있다. 원고가 근본적으로 처분사유가 전부 존재하지 않는다고 주장하는 사안에서, 처분사유 부존재 주장은 받아들여지지 않은 채 절차적 하자, 처분양정 과중 등의 주장이 받아들여져 해당 처분을 전부 취소하는 판결이 선고되더라도, 비록 판결주문에서는 100% 승소하였으나 판결 이유에서는 원고에게 100% 만족스러운 결과가 아니다. 그럼에도 이 경우에 원고에게는 그 취소판결에 대해 상소할 이익을 인정하지 않는 것이 대법원의 확립된 판례이다. 민사소송, 특히 금전청구소송에서는 법원의 판결로써 적어도 당해 소송물에 관한 원·피고 사이의 분쟁이 종국적·규범적으로 해결된다. 반면, 항고소송에서는 처분사유가 모두 존재하지 않는다고 판단되는 예외적인 사례를 제외하면, 행정청이 취소판결이 지적한 위법사유를 시정하여 재처분을 할 것이 예정되어 있으므로, 취소판결로써 원고와 피고 행정청 사이의 분쟁이 완전히 해결되지 않는다는 특징이 있다. 행정청은 상소하지 않고 원심의 취소판결을 확정시킨 후, 판결에서 위법사유로 지적된 하자를 시정하여 재처분을 할 수도 있다. 이 경우 원고는 재처분에 대해 취소소송을 제기하여 처분사유의 부존재를 다시 주장하여야 하고, 후속소송에서 이 주장이 배척되어 주문에서 청구기각 판결이 선고되는 경우이어야 상소의 이익이 인정되어 비로소 상급심에서 ‘처분사유의 부존재 주장’의 당부에 관하여 판단을 받아볼 수 있게 된다. 이러한 해결방법은 원고에게 취소소송을 2번 이상 제기하도록 강요하는 것이어서 매우 불합리하다. 항고소송이 위법한 처분으로부터 국민의 권리를 실효적으로 구제해 줄 수 있는 분쟁해결절차가 되려면 그 처분과 관련한 법적 분쟁이 가급적 1회에 해결되도록 상소의 이익을 인정하는 것이 바람직하다. 민사소송에서도 상소의 이익은 형식적 불복설에 따라 획일적으로 판단되는 것이 아니라, 판결주문상으로는 전부 승소한 당사자라고 하더라도 판결 이유에서 실질적인 불이익이 있는 경우에는 분쟁의 합리적 해결을 위해 예외를 인정하고 있다. 항고소송에서는 ‘분쟁의 1회적 해결’이 더욱 강하게 요청된다. ‘분쟁의 1회적 해결 요청’은 이미 항고소송에 관한 법리에 다양하게 반영되어 있다. 독일의 항고소송에서는 원고가 판결주문에서 전부 승소한 경우 상소의 이익을 부정하는 것이 원칙적인 통설·판례이다. 그러나 한편으로 독일 행정소송법에서는 의무이행소송, 처분의 위법판단 기준 時로서 판결 時 채택, 소송계속 중 절차적 하자의 치유 허용을 통해 분쟁의 1회적 해결이 가능하도록 보장하고 있으므로, 우리나라와는 문제상황이 근본적으로 다르다. 다른 한편으로, 독일의 항고소송에서도 해당 판결을 통해 분쟁이 1회적으로 해결되지 않고 해당 판결의 이유가 후속 재처분이나 후속 소송에 영향을 미치는 예외적인 경우에는 판결 이유 중의 불리한 판단에 대해 상소의 이익을 인정하고 있다. 기존 판례에 의하면, 수소법원이 처분에 절차적 하자가 있음을 이유로 취소판결을 할 때에, ⅰ) 만약 실체적 하자 유무에 대해 명시적으로 판단하지 않는다면 심리미진, 판단회피라는 비난을 받고, ⅱ) 만약 실체적 하자가 존재하지 않는다고 명시적으로 판단할 경우에는, 원고에게 불복의 기회도 보장되지 않는 판국에 괜히 불필요한 판단을 하여 재처분 및 그에 대한 후속소송에서 원고를 불리한 상황에 놓이게 한다는 비난을 받는 딜레마 상황에 처하게 된다. 이러한 딜레마 상황을 타개하기 위해서는 절차적 하자를 이유로 처분을 취소하는 판결 중 ‘실체적 하자는 없다는 판단 부분’에 대해 한편으로는 원고에게 상소의 이익을 인정하여 상급심에서 다시 판단받아 볼 기회를 부여하고, 다른 한편으로는 그러한 기회가 보장됨을 전제로 확정판결 중 ‘실체적 하자가 없다’는 판단에 대해 원고가 향후 재처분절차 및 이에 대한 쟁송절차에서 더 이상 다툴 수 없도록 구속력(쟁점효)을 인정하는 것이 바람직하다.

Abstract

In an appeal litigation, there are various grounds for unlawfulness to revoke a disposition. With respect to a case where the plaintiff basically asserts the complete nonexistence of dispositive grounds, albeit judgment is rendered revoking said disposition in entirety by rejecting the plaintiff’s nonexistence claim while accepting the assertion on procedural flaw, excessiveness in assessment of disposition, etc., the plaintiff may appear to have won the case in the text of the decision whereas it may not be a favorable outcome on the part of the plaintiff in the rationale of the decision. Nevertheless, in such case, the Supreme Court’s established position has been to deny the plaintiff’s benefit of lawsuit regarding the judgment revoking the disposition. In a civil litigation, namely, a lawsuit seeking monetary compensation, a dispute regarding the subject-matter of lawsuit between the plaintiff and the defendant is ultimately and normatively settled through a court ruling. On the other hand, precluding exceptional instances where dispositive grounds are deemed to be completely nonexistent in an appeal litigation, a dispute between the plaintiff and the defendant (administrative agency) is not fully resolved through a revocation judgment, inasmuch as the competent administrative agency is likely to reintroduce a dispositive measure by correcting the grounds for unlawfulness as pointed out in the revocation judgment. Upon the lower court’s revocation judgment becoming final and conclusive, an administrative agency, without initiating a suit, may reissue a dispositive measure by correcting the flaw indicated as the grounds for unlawfulness in the judgment. In this case, the plaintiff is required to reassert the nonexistence of dispositive grounds through filing another lawsuit seeking revocation for the reintroduced dispositive measure. Furthermore, the plaintiff’s benefit of lawsuit is recognized only when the plaintiff’s claim brought in a subsequent suit is rejected and the judgment dismissing the same is delivered in the text of the decision, thereby paving the way for the plaintiff to be rendered a decision in a higher court as to the legitimacy of the “assertion on the nonexistence of dispositive grounds.” Such method of resolution is unreasonable given that it compels the plaintiff to instigate a revocation suit more than two times. For an appeal litigation to function as a dispute settlement procedure that can effectively provide remedy against infringement of the public’s right due to an unlawful disposition, it would be desirable to recognize the benefit of lawsuit to the effect that a legal dispute relating to the disposition in question is resolved the first time, if possible. Likewise, in a civil litigation, the benefit of lawsuit is not uniformly determined according to a perfunctory appeal theory; rather, to ensure that a dispute is reasonably settled, exceptions are acknowledged in cases where a substantial disadvantage exists for a party in the rationale of the decision even if said party was handed down a whole favorable judgment in the text of the decision. There is stronger demand for “one-off dispute resolution” in an appeal litigation. The “request for one-off dispute resolution” is already diversely reflected in the legal doctrine on appeal litigation. For example, in Germany, where the plaintiff wins an appeal suit in entirety, the benefit of lawsuit is denied according to the common theory and judicial precedents, as a matter of principle. However, on the other hand, the Administrative Procedure Act of Germany (Verwaltungsverfahrensgesetz) guarantees a one-off dispute resolution through permitting (i) the instigation of compulsory performance lawsuit, (ii) the date when a judgment is rendered to be set as the base period for determining the unlawfulness of a disposition, and (iii) the correction of a procedural flaw while a lawsuit is pending. That said, the relevant issues are fundamentally different between Korea and Germany. On the contrary, in such extenuating circumstances where a dispute is not settled the first time through a court ruling in an appeal litigation and the rationale of the decision affects the ex post dispositive measure to be reintroduced or the subsequent suit to be filed, German law recognizes the benefit of lawsuit as to an unfavorable part of the judgment in the rationale of the decision. According to a previous judicial precedent, where the court hearing a lawsuit delivers a revocation judgment on grounds that there exist a procedural flaw regarding a dispositive measure, this may lead to the following conundrum for the court: (a) face criticism for failing to exhaust all necessary deliberations and avoiding judgment if unable to explicitly determine the existence or absence of a substantive flaw, or (b) if explicitly determining that a substantive flaw is nonexistent, face criticism for making an unnecessary determination in a situation where the plaintiff is not granted an opportunity to object to the disposition and placing the plaintiff at an unfavorable position in the subsequent suit relating thereto. To overcome such conundrum, of the judgment revoking a disposition on grounds of a procedural flaw, i.e., “the portion determining that no substantive flaw exists,” the plaintiff’s benefit of lawsuit can be recognized so that he/she may be granted an opportunity to be heard again in a higher court. On the other hand, premised on the fact that such opportunity is granted, as regards the part of the final and conclusive judgment ruling “no substantive flaw exists,” it may be tenable to acknowledge binding force (issue preclusion) to disable the plaintiff from further challenging the re-dispositive measure and disputing the same in subsequent legal proceedings.
