중국 부동산등기제도에 관한 연구

부동산거래관계에서 가장 중요한 것은 ‘권리관계의 공시’이다. 중국에서도 부동산등기의 주요 목적은‘공시(公示)’이며, 물권의 공시 방법 중 제일 중요한 것은 ‘부동산등기제도’이다. 이 논문의 연구목적은 2000년 이후 활성화된 중국의 부동산 거래를 보다 체계적으로 이해하기 위해 부동산등기제도의 변화와 특징을 연구하는 것이다. 주요 연구내용은 다음 세 가지이다. 첫째, 중국 개혁기 부동산등기제도가 어떤 법률적 변화를 거쳐 형성되었는지 살펴보았다. 특히 2007년 물권법(物權法) 제정 전후 제도를 비교함으로써 중국에서 통일적인 부동산등기제도가 실시되는 과정을 설명했다. 둘째, 중국은 등기대상 부동산 권리와 등기기관을 어떻게 규정하고 있는지 설명했다. 셋째, 중국의 부동산등기제도가 한국과 어떤 면에서 다른지 연구했다. 이를 통해 중국 부동산등기제도의 특징을 설명했다. 이 연구는 물권법 이후 통일적인 부동산제도가 어떻게 정착되어 가는지, 이런 제도의 특징과 한계는 무엇인지를 보다 체계적으로 이해할 수 있다는 점에서 기존연구와 차별성을 지닌다.
Abstract
The most important thing in real estate transaction is on the 'public announcement of rights relations'. In China, the main purpose of real estate registration is on its ‘public announcement’, and the most important method of the public announcement is the ‘real estate registration system’. The purpose of this paper is to study the changes and characteristics of the real estate registration system in China in order to better understand the active real estate transactions in Chinese markets since 2000. The paper introduces the three main contents regarding the real estate registration system in China. Initially, the legal changes of the real estate registration system was reviewed. In particular, the process of unified real estate registration system was explained before and after the enactment of the Real Right Law establishment in 2007. Secondly, definitions of the real estate rights and registration authority were reviewed. Lastly, characteristics of the Chinese real estate registration system were explained with comparison to the Korean system. This study provides a different perspective by systematically investigating the overall process, characteristics, and limitations of the unified real estate system settlement after the property rights law in China.
