대의민주주의 정착을 위한 개선방안에 관한 연구 -부패방지를 위한 국회의원에 대한 국민소환제도를 중심으로-

As the 20th National Assembly operates in a dysfunctional way, following the 18th and 19th National Assembly, the introduction of a national recall system of National Assemblymen has been called for as a way to improve representative democracy. It is frequently pointed out that the current system does not have enough means of sanctions against the National Assemblymen, as their status is guaranteed strongly by the privileges of immunity from arrest and of exemption from liability provided in the Constitution. Also, If elected, the office of the alleged National Assemblymen maintains unless a sentence of more than one million won is sentenced in the final judgment of the judiciary. Therefore, national recall of the National Assemblymen, other than the general election, is an effective way to realize the political responsibility by directly judging them by the people. In particular, the role of the national recall system is not only to dismiss the National Assemblymen but also to establish mature representative democracy by raising the ethics and self-improvement ability among themselves. This paper examines the legislative examples and effectiveness of the national recall system of the National Assemblymen, points out the limitations of legislation proposed by the 20th National Assembly, and explores specific measures for improvement.
