다양한 가족 유형의 확산에 따른 「민법」의 개선 과제 검토

A Study on the Improvement of Civil Law due to the Spread of Various Family Types

Objective indicators such as the Statistics Korea and the Ministry of Gender Equality and Family already show that our society is changing from a typical family form to a variety of forms, and that people’s social acceptance of various families has increased. This is the result of a change in the individual’s family values in the way the family is organized, and therefore the choice of the individual has been expanded. The coexistence of these various family types means that even in law and policy, only certain types of family cannot be recognized and targeted. In line with the changes, the government is pushing for policies to embrace various family types through the “Basic Plan for Ageing Society and Population Policy” and “Basic Plan for Healthy Families”. Related private studies call for the deletion of Article 779 on the scope of families under civil law. In this regard, we observed that the deletion of Article 779 of the Civil Law is not a direct solution to the problem through Acts stipulating family and similar terms including Article 779 of the Civil Act and cases of various family types. However, considering that the Family in Civil law based on marriage and blood ties is not a major household, and that there are already various types of families appearing in our society, the prejudice in perception of them will continue to be maintained if Article 779 of the Civil law is not deleted, and the deletion of regulations on the scope of families alone will contribute greatly to the paradigm shift in family types, I propose the deletion of Article 779 of the Civil Law. The concept of a family including various combinations is to have its definition in the Framework Act on Healthy Families, the basic law of family policy. In addition, it is proposed to improve family-related regulations and terms, and to prepare laws for various combined relationships and introduce an inheritance rights exclusion system.
