디지털 플랫폼에 대한 주요국 규제체계의 비교법 연구 - 독점규제법을 중심으로 -

초록

전 세계적으로 기업의 사회적 책임과 개인정보 보호의무가 중대한 문제인바, 각 국은 디지털 플랫폼에 대한 현행 규제체계를 개선하고자 노력하고 있다. 디지털 플랫폼의 양면·다면시장은 완전히 새로운 시장구조가 아니며 기존에도 존재해온 시장이므로 독점규제법의 법적 도구가 충분히 적용될 수 있다고 보기도 한다. 디지털 플랫폼의 경쟁 제한적 효과에 대해서는 이론적·실무적으로 합의된 원칙이 부족하므로 독점규제법 체계에 대한 갑작스런 변동은 지양해야 할 것이다. 그러나 일부 디지털 시장의 진입장벽을 축소하기 위해 경쟁자들 간에 디지털 비즈니스의 핵심 자산인 ‘데이터’ 공유의 중요성이 부각되면서, 각 국은 독점규제법 및 기타의 법령을 통해 디지털 플랫폼에 대한 규제방식을 발전시키고 있다. 각국의 독점규제체계는 독점화 시도 내지 시장지배적사업자의 지위남용 금지 및 기업결합 규제영역에서 관련 규정을 마련하고 있다. 비록 독점규제법의 목적이 경쟁과 소비자를 보호하는 것인 반면에 디지털 플랫폼의 무상 서비스 제공은 소비자 후생을 감소시키지는 않지만, 관련시장 획정 시 무상 서비스 제공시장도 관련시장에 포함하는 것이 최근의 경향이다. 독일과 오스트리아의 방식에 따라 기업결합의 사전 신고기준에 기존 자산·매출액과는 별도로 거래금액을 포함시키거나, 일본의 방식에 따라 데이터에 대한 시장지배력의 문제를 심각하게 인식하여 기업결합의 사전통제 및 시장지배적지위의 남용규제를 위한 보다 세부적인 지침을 마련할 필요가 있다. 또한 일부 디지털 시장의 기업결합 계획에 대해서는 공익성 심사도 고려하겠다는 영국 입법부의 논의도 주목할 만하다. 디지털 플랫폼에 대한 규제는 독점규제법 이외의 법령을 통해 추진하기도 한다. 프랑스는 기존 소비자보호법을 개정하여, 온라인 플랫폼 운영자가 소비자에게 전문가의 재화·서비스 가격과 특징에 대한 비교 서비스, 비교의 조건에 영향을 미치는 정보 및 자유로운 이용이 가능한 온라인 공간을 제공하도록 하였다. 아울러 세계 각국은 디지털 시대에 플랫폼의 경쟁 제한적 행위를 적합하게 규제하기 위한 법률이나 제도를 마련하고 전문성을 가진 전담기구를 설치했거나 설치하려고 한다는 점을 직시하여, 전 국가적 차원의 디지털 경제를 위한 미래지향적인 법제를 정비하고 이를 운영할 별도의 기관을 설치할지 여부를 고려해야 할 시점이다.

Abstract

Global corporate social responsibility and privacy obligations are critical issues, and countries are trying to improve the current regulatory framework for digital platforms. The two-sided or multi-sided market of digital platforms is not a completely new market structure, but it is a market that has existed in the past. Since theoretically and practically agreed principles of the digital platform’s limited competition are lacking, sudden changes to the antitrust regulatory system should be avoided. However, as the importance of sharing ‘data’-the core asset of digital business among competitors is emphasized to reduce the barriers to entry in some digital markets, countries have developed regulations on digital platforms through antitrust regulations and other laws and regulations. Each country’s antitrust regulatory system has established regulatory frameworks in the areas of prohibition of ​​attempt to monopolize or abusive conduct by market dominant business entities, and control of business combinations. Although the provision of free services on digital platforms does not reduce consumer welfare while the goal of the antitrust law is to protect competition and consumers, antitrust laws recently tend to include such a free service market in defining a relevant market. Germany and Austria has introduced the criteria for transaction amount of merger into the pre-merger notification standard, and Japan has seriously recognized the issues of market power for data access rights and established detailed guidances for control of business combinations and abusive conduct by market dominant business entities. Besides it worth noting the UK legislature's active discussion of a public interest review for some digital market combinations. Proper regulations on digital platforms may be accomplished through legislation other than antitrust laws. France amended the consumer protection laws, obligating online platform operators to provide consumers with comparative services on the prices and characteristics of specialist goods and services and information affecting the conditions of comparison, and to allow consumers to freely use online spaces to access such information. Countries have established or are trying to establish a dedicated agency with expertise in regulating anticompetitive conduct of digital platforms in the digital economy era.
