동적화상디자인의 디자인법상 성립요건에 관한 실무적 고찰

Recently, with the growing interest in design areas incorporating new technologies such as augmented reality and virtual reality, issues regarding protection of animated GUI design are emerging. Major issues in practice focusing on the requirements of animated GUI design in the Design Protection Act will be dealt with in this paper. A fact that animated GUI design expressed by constant screen changes and dynamic transition and has dynamic properties such as graphical, physical, spatial and temporal variations is discovered. Most of jurisdictions, animated GUI design is protected and is expressed through drawings linked in the form of images. Also, there is a debate regarding the drawing representation method of hologram and augmented reality, which is applied in the form of animated GUI design. The following features are found regrading the requirement of animated GUI design. Concerning requirement of visual relevance, it is understood as the concept of unity, in which visual characteristics are shared, presupposing unity of function. It might be supposed that an idea which the requirement of transitional consistency is presented through the formation of a dynamic character with regularity and is related to the clarity of the scope of protection. Following direction of policy improvement for protection of animated GUI design is suggested to reflect these trends. It is necessary to establish clear concept of animated GUI design, expand the scope of recognition of visual relevance and transitional consistency in practice, study on new types of animated GUI design protection such as interaction in hologram and multiple display, and readjust the video file system as an alternative drawing representation.
