전통지식에 관한 국제기구 논의 비교 연구 : WG8j와 WIPO/IGC를 중심으로

As the Nagoya Protocol has taken into effect in Republic of Korea since 2017, discussions on the protection, access, and benefit-sharing of genetic resources and traditional knowledge associated with genetic resources that are the subject of the Nagoya Protocol has been actively conducted. At present, discussions on the protection of traditional knowledge and benefit-sharing are being conducted through international organizations such as the UN Convention on Biodiversity and the World Intellectual Property Organization. The discussion on protection of traditional knowledge has begun because of the recommendation of respect, preservation and benefitsharing of traditional knowledge as set out in Article 8 (j) of the Convention on Biological Diversity. One of them is to form a WG8j to improve the effectiveness of benefit-sharing, and the other is to negotiate ‘The protection of traditional knowledge’ at the World Intellectual Property Organization. This study examines the contents of voluntary guidelines and traditional knowledge negotiations, which are the results of discussions on traditional knowledge at WG8j and WIPO / IGC, and compares the directions of discussions at the two international organizations. The results of the two international organizations are reviewed to suggest the ways to protect domestic traditional knowledge and to access and use foreign traditional knowledge.
