규제지도(Regulation Map)를 활용한 기술지주회사 설립·운영 규정 비교 연구

This paper is purposed to understand the latest situation of Technology Holding Companies and suggest improvement plans about the policy which has continuous problems since a related amendment in 2013. Therefore first, this paper will consider how to see current Technology Holding Companies, comparing to legal principles of general holding companies. Even though technology holding companies use a word ‘holding company’, it is hard to apply legal principles of general holding companies. As a requirement of establishment, technology holdings are forced to invest a technology by the law, and unlike general holdings are regulated by Commercial Act or Monopoly Regulation and Fair Trade Act, technology holdings are regulated by different laws. From these differences between both holding companies, the paper analyzes distinctions in legal principles between technology holdings and general holdings. Also, through an analysis of the current state about technology holdings policy and each act about a foundation and management of companies, the paper complete a regulation map, organizing every procedures of the foundation and management. Using this regulation map, the paper finds defections of the policy by comparing how much differences exist in the procedure, and suggests improvement plans.
