호주 법원 판결에 기한 집행판결 청구의 소에서 번호계인 원고의 당사자능력

민사소송법상 소송의 당사자가 되어 소송을 수행하여 본안판결을 받기 위해서는 우선 당사자능력과 소송능력이 있어야 한다. 민사소송법은 제51조와 제52조에서 당사자능력을 규정하는데 그 조문들이 당사자가 외국인 또는 외국회사인 경우 어떤 의미를 가지는지가 문제된다. 여기에서는 당사자능력을 다룬 2015년 대법원 판결에 대하여 평석을 한다. 이는 호주에 거주하는 한국인들이 조직한 번호계가 원고로서 계원인 피고를 상대로 호주 법원에서 승소판결을 받아 한국에서 집행판결을 청구한 사건이다. New South Wales 대법원이 원고의 당사자능력을 긍정하였음에도 불구하고 우리 법원들은 마치 국내 번호계가 제소한 것처럼 계에 관한 법리를 적용하여 당사자능력을 부정하였다. 여기에서는 민사소송법 제51조, 제52조와 제57조에 비추어 그런 결론이 정당한지를 검토한다. 이 사건 론 클럽 계약의 준거법이 한국법이라고 볼 여지도 있으므로 필자는 대법원의 결론이 틀렸다고 단정하지는 않는다. 다만 우리 법원이 이 사건 론 클럽 계약의 준거법에 대하여 전혀 판단하지 않고, 당사자능력에 관하여 민사소송법 제57조의 유추적용 또는 민사소송법에 쓰이지 않은 저촉규범에 따라 호주 소송법으로 지정할 가능성을 전혀 고려하지 않은 것은 아쉽다. 이 사건에서 원고를 구성하는 계원들의 목록이 호주 판결문에 첨부되어 있어 명확히 특정되어 있었던 점을 고려할 때 아쉬움이 더욱 크다.
Abstract
In order to be a party to a lawsuit under the Civil Procedure Act of Korea (“CPA”) and to carry out a lawsuit, one must have the capacity to become a party and the capacity to carry out a lawsuit. While the CPA regulates the capacity to become a party in Articles 51 and 52, questions arise as to the meaning of said provisions in cases where the parties are foreigners or foreign companies or organizations. In this article, the author reviews the Korean Supreme Court judgment of 2015, pertaining to a case in which the plaintiff, a so-called “Kye” (a traditional Korean savings plan named in the case in question Surry Hills Mutual Loan Club) composed of Koreans residing in Australia, filed a suit in South Korea seeking an enforcement judgment based upon a favorable judgment from a court of the State of New South Wales. Although the Supreme Court of New South Wales affirmed the plaintiff's capacity to become a party in a lawsuit in New South Wales, the Korean courts denied it by applying a doctrine applicable to the so-called “Kye”, as if it was the domestic “Kye” who had filed. The author examines whether such conclusions could be justified in light of Articles 51, 52, and 57 of the CPA. Since the law applicable to the loan club contract forming the Surry Hills Mutual Loan Club in this case may be the Korean law, the author does not argue that the Supreme Court’s conclusion is definitely wrong. However, it is regrettable that the Korean courts did not decide at all on the law applicable to the loan club contract, nor take into consideration the possibility of referring to the civil procedure law of New South Wales through either an application by analogy of Article 57 of the CPA or the application of choice of law rules unwritten in the CPA. All the more so considering that the list of the members of the “Kye” who make up the plaintiff in this case was actually attached to the judgment of the New South Wales and was thus clearly identified.
