스포츠 베팅 게임에 대한 규제 및 입법개선 방안의 모색 - 스포츠 베팅 게임에 대한 판례분석을 중심으로 -

최근 스포츠 베팅 게임에 대한 일련의 판결들은 스포츠 토토와 같이 국가가 도박에 대한 예외를 허용한 사행행위영업을 모사하여 정보통신망을 통해 제공하는 스포츠 베팅성 게임물에 대하여 게임산업진흥법, 사행행위특례법, 국민체육진흥법 등 사행행위 금지 규정의 적용상 한계를 명확하게 제시하고 있다. 법원은 일관되게 스포츠 베팅성 게임에 대하여 ‘게임머니의 환전가능성’이라는 기준을 제시하면서 이러한 환전가능성이 존재하지 않는 경우에는 해당 게임의 사행화 가능성이 존재할 수 있다고 하더라도 그 자체만으로 게임물등급분류를 거부할 수 있는 사정으로 볼 수 없으며, 이는 결국 사후관리의 문제에 해당한다는 잠재적 결론에 이르고 있다. 그러나 이러한 스포츠 베팅 게임이 기존의 합법적 스포츠 베팅과 불법 스포츠도박과의 경계선에 있다는 의구심은 여전히 존재하고, 장기적 관점에서 합법적인 스포츠게임으로 전환되어야 한다는 주장과 더불어 최근에는 게임산업진흥법 시행령 별표2 제8호에서 웹보드게임의 하나로 스포츠 베팅 게임을 추가한 내용이 입법예고 되는 등 스포츠 베팅 게임에 대한 규제가 본격화되고 있다. 이러한 현재의 상황에서 스포츠 베팅 게임에 대한 기존 판례 등을 재검토 해보고 향후 스포츠 베팅 게임의 규제 방향성에 대한 시사점을 찾고자 한다.
Abstract
For sports betting games which are provided through the telecommunications network, mimicking the business of meandering business that allows exceptions to gambling, the courts consistently denied the criminal responsibility for them. If the possibility of exchange of money does not exist while presenting the standard, even if there is a possibility of meandering of the game, it cannot be regarded as a situation that can be denied the classification of the game by itself, which is a matter of ex post management. A potential conclusion is coming. However, the suspicion that such sports betting games are at the borderline between existing legal sports betting and illegal sports betting still exists, and in the long term, it has been argued that they should be converted into legal sports games. Regulations on sports betting games are in full swing, with the issue of adding a sports betting game as one of the web board games. This legislative direction may be that the government did its best to prevent the betting of sports betting games, but the problem of the limitation of mandatory legislation can still be pointed out. In other words, it is necessary to define more detailed contents such as how to establish user protection measures through discussion with the Game Rating And Administration Committee, how the contents are, and how to view the administrative system in case of violation. In particular, the existing web board games and sports betting games are defined in spite of the differences in their methods and characteristics. Therefore, problems related to the establishment of user protection measures and the 3implementation of compliance requirements still remain. It is also regrettable that the exchange ban has not been clearly defined in the game system. Nevertheless, it is expected that these problems can be solved through efforts to establish a public management cooperative post-management system in consultation with the game companies and the Game Rating And Administration Committee.
