2019년 민사소송법 중요 판례 분석

초록
2019년에도 민사소송법(이하 단순히 ‘법’이라고도 한다) 영역에서 많은 중요한 대법원 판결들이 선고되었다. 이 논문에서는 그 중 5개의 중요판결을 선정하여, 대상판결의 ‘사안의 경과’, ‘판결의 요지’, ‘분석’의 순서로 각 판결들을 살펴보고자 한다. 이들은 (i) 국제재판관할의 판단기준, (i) 구상금분쟁조정위원회의 조정의 효력, (i) 장래이행판결의 주문의 표시방법, (iv) 시효중단을 위한 재소, (v) 참가승계와 피승계인의 탈퇴에관한 주제를 담고 있다. 대상판결의 ‘분석’ 부분에서는 가능한 범위에서대상판결의 이론적 기초가 되는 법적 쟁점을 먼저 살펴보고, 대상판결이가지는 소송법상의 의미를 되짚어 보는 방법으로 살펴보고자 한다. 2019 년에 선고된 판결만을 대상으로 삼다보니 아직 대상판결들에 대한 학계의 논의가 충분하지 않은 상태이다. 또한 각각의 판결들이 개별 논문으로살펴보아야 할 만큼 중요하면서도 많은 쟁점을 담고 있어 하나의 논문에서 이들 모두를 충실히 담아내기에는 한계가 있는 것 같다. 이들 주제에대한 보다 심층적인 논의가 이어지기를 기대한다.
Abstract
In 2019, a number of important Supreme Court Decisions were anounced in the area of the Civil Procedure Law. This paper comments on 5 important judgments. Each section examines the progres of the case, the main point of judgment and analysis. This article contains the isue of (i) the guideline of international jurisdiction (i) the efect of mediation of the commite for dispute over recourse amount (i) the way to expres judgment of future performance (iv) refilng the same lawsuit for interuption of extinctive prescription (v) intervented sucesion and secesion of predecesor. In the part of ‘analysis’, a legal isue of judgment which is being the theoretical foundation, wil be first discused. Review about the meaning of judgment is folowed. Since only judgments sentenced in 2019 are considered in this article, these judgments are not suficiently discused in academia. The discusion of these isues are expected to be continued in-depth.
