이세돌 9단과 알파고(AlphaGo)의 세기의 바둑대결 이후, 사람들은 인공지능(Artificial Intelligence; AI)에 대한 관심이 높아졌다. 이 바둑대결은 인공지능에 대하여 우리 사회 전반에 걸쳐 관심을 보이지 않았던 사람들까지 큰 관심과 반향을 불러 일으켰다. 이는 인공지능 기술이 특정 영역에서 인간의 사고력과 판단력을 뛰어넘을 수 있음을 단적으로 보여주고 있으며, 나아가 새로운 사회적 화두를 던진 것으로 평가되고 있다. 이 사건 이후, 다양한 분야에서 AI와 관련한 논의가 활발하게 이루어졌으며, 특히 규범학의 영역인 법학 분야에서 인공지능의 현안에 관한 대응방안을 제시해야 한다는 의견이 제기되었다. 인공지능의 활용은 인류에게 편의성과 경제적 이익을 주지만, 동시에 다양한 사회적 문제를 일으킬 수 있다. 향후 인공지능의 활용은 다양한 분야에서 상용화되고 우리 생활 전반에서 그 영향력은 매우 커질 것이라는 것은 부인할 수 없는 사실이다. 따라서 인공지능을 위험이라는 측면에서 살펴볼 필요가 있고, 이러한 위험의 특성에 근거한 법적 규제 방안을 마련하는 것은 시급한 과제가 아닐 수 없다. 그러므로 관련 산업을 진흥시키고자 하는 노력과 더불어 예상되는 문제들을 해결하거나 조정할 수 있는 방안에 대해서도 진지하게 고민할 필요가 있다. 이러한 취지에서 본 논문은 인간에게 이로운 지능정보사회의 구현을 위해 인공지능의 현안에 필요한 입법의 방향과 기본원칙을 모색하고자 한다. 이를 위해 인공지능의 법적 지위를 분석하고, 인공지능의 현안에 대한 입법 과제를 제시하고자 한다.
Abstract
After the Go match of the century between Lee Se-dol 9 Dan and AlphaGo, people became more interested in artificial intelligence (AI). The Go match has aroused the interest and reverberation of those who did not show much interest in AI throughout the society, and AI is evaluated to have emerged as a new social topic. This is a simple example of how the artificial intelligence technology can surpass human thinking and judgment in certain areas. After this event, there have been active discussions about AI in various fields, especially in the field of law, the area of normative science. The use of artificial intelligence gives economic benefits and convenience to mankind, but it is expected to cause various social problems at the same time. As shown above, it is undeniable that AI will be commercialized in various fields and will be very influential, but the corresponding legal system is still insufficient. Furthermore, it is necessary to examine the risks of AI from various perspectives, and it is urgent to devise appropriate legal regulatory measures based on the characteristics of these risks. Therefore, in addition to the efforts to promote related industries, it is necessary to think seriously about how to solve or adjust the expected problems. To this end, the purpose of this paper is to discuss legislative issues on the current issues of AI, and then aim to overcome various issues related to AI and move forward to a society where AI and humans coexist.
