신종 감염병 전염과 국가의 손해배상책임에 관한 연구: 메르스 판결을 중심으로

초록
한국에서 메르스, 코로나19 등의 신종 감염병이 지속적으로 발생하고 있다. 이에 따라 향후 발생하는 신종 감염병에 대해 효율적으로 대처하기 위해서 이미 발생한 감염병에 대한 정부 대응이 적절했는지 살펴봄으로써 법률적･제도적 차원뿐만 아니라 인적자원의 미흡한 부분을 개선할 수 있다. 이에 본 연구는 메르스에 대한 국가의 진단검사 지연과 역학조사 부실로 인하여 다른 환자로부터 메르스에 전염된 피해 사례를 주목하였다. 이를 위하여 법원 홈페이지를 검색하고 판결서를 열람하여 지금까지 선고된 5개 사건을 분석하였다. 법원은 메르스에 전염된 피해자 또는 유족이 국가를 상대로 제기한 손해배상청구소송에서 유사 사례에 대해 국가의 과실, 전염의 인과관계를 다르게 판단하였다. 본 연구는 메르스 사태에서 국가 과실에 따른 손해배상청구소송에 대해 처음으로 분석함으로써 신종 감염병 전염에 따른 국가의 손해배상책임에 대한 판례의 동향을 파악하고, 나아가 신종 감염병 관리에 대한 법적용의 미비점을 보완하며 의료제도와 인력 전반에 대한 취약요인을 개선하여 국민 건강권을 담보하는데 기초자료를 제공했다는 점에서 연구 의의가 있다.
Abstract
Recently, emerging infectious diseases such as MERS and Corona19 have continued to occur in Korea. By examining whether the government's response to emerging infectious diseases was appropriate, it will be necessary to diagnose not only the legal and institutional levels but also the faults of the employee in charge. Based on this, the government should effectively deal with emerging infectious diseases that will occur in the future. We gave attention to the damage cases infected by MERS patients due to delays of diagnostic check and poor epidemiologic investigations. We collected five precedents declared so far through searching the court's website and reading the written judgment. We will identify the trends in the precedents of the contagion of emerging infectious disease due to state negligence and liability for damages and further provide basic data to ensure the right to health by supplementing the faults of application of the law for the management of emerging infectious diseases.
