북한 지적소유권 법제의 북한 헌법상 근거 등에 관한 소고

초록
디지털 시대에, 과학기술 선진국들에게 둘러싸인 시공간 속의 남북한이민족 생존을 위하여 지식재산에 관심을 갖는 것은 당연하다. 이에 지식재산을 중심으로 한 글로벌 경쟁 체제의 시각에서 볼 때 북한 지적소유권법 체제및 그 뒷배가 되는 과학기술정책에 대한 이해는 이미 단기과제이다. 남북한의 지식재산권 제도는 비록 목적과 내용이 형식적으로는 유사하지만, 그 배경이 되는 사상은 경제발전을 위한 과학기술발전 도구라는 최소한의 인식만제외하고는 근본적으로 많이 다르다. 이는 일반재산권 제도와 헌법의 체계적 지위의 차이점에 주로 기인하므로 북한의 지적소유권은 북한 체계 내에서 이해될 필요가 있다. 이를 위하여 첫째, 북한 지적소유권 및 관련 과학기술 영역의 헌법적 근거를 살펴보는데, 특히 생산수단의 사유화를 인정하지않는 북한 헌법에서 지적소유권이 어떤 형식으로 헌법에 도입되었는지를 규명하여야 할 것이다. 둘째, 구체적인 북한 지적소유권 관련 개별법의 특징을북한 헌법에 비추어 고찰하여야 할 것인데 관련선행연구 중 드러난 대표적인 차이점을 대상으로 한다. 북한 지적소유권법은 북한 특유의 사회주의 이념을 반영하고, 국가의 개입을 중요시하고 있기 때문에, 자본주의 시장경제이념에 근거한 우리 지식재산권법과는 차이점이 뚜렷하다. 그러므로 우리의시각이 아닌 북한 헌법질서의 시각에서 북한 지적소유권 제도의 본질을 파악하기 위한 접근방법은 미래 세대들의 북한제도 이해에 새로운 시각을 제공할 수 있을 것이다.
Abstract
In the digital age, it is natural for ‘2 Koreas’ to be interested in Intellectual Property(“IP”) for people’s survival. So, from the perspective of a global competition system, the understanding of North Korea(“NK”)’s IP system and the science-technology policy is already a short-term task. Although NK’s and our IP systems are similar, the basic idea is fundamentally different, except for the minimal recognition for the development of science and economic development. Above all, it is necessary to discuss how to understand NK’s IP rights because NK’s general property rights system and the systematic status of the Constitution are totally unlike. To this end, first, Constitutional grounds with NK IP rights will be examined. In particular, the NK’s Constitution, which does not recognize the privatization of the means of production, should be analyzed for what IP means. Second, it is necessary to concretely study the characteristics of individual IP rights in the light of the NK’s Constitution, not from South Korea’s view. It is expected to provide a new view point to future generations looking forward Unification.
