자율주행 상용화를 위한 법제도 방향성 검토

Autonomous driving technology, a representative technology of the 4th industrial revolution, is developing day by day. In order for the era of autonomous vehicles to truly come, the legal system must be reorganized. While advanced countries are struggling to develop legislation, Korea is also in need of preparing for it. First, autonomous vehicles need to design ethical standards. This is because in the case of a fully autonomous vehicle, a traffic accident may occur without the value judgment by a man. Through social publicization, it is necessary to create standards that meet Korean consciousness. Meanwhile, the regulatory sandbox system is being implemented in a legal system. However, this is only a temporary measure and legal preparation is needed. The amendments that have been submitted to the National Assembly so far, an attempt to resolve some legal issues about administrative regulations or privacy laws. Even if the amendments are passed, they will only address the legal issues on some parts. However, meaningful legislation was recently enacted and revised to prepare for everyday use of autonomous vehicles. This is a revision to the Autonomous Vehicle Act, which has been in effect since May 1, 2020, and the Automobile Damage Compensation Guarantee Act, which is scheduled to take effect on October 8, 2020. In particular, the Autonomous Vehicle Act stipulated matters necessary for the introduction and diffusion of autonomous vehicles and the creation and support of a driving base for safe operation. Although the legal basis for promoting everyday use of autonomous vehicles has been established, it is still in the early stages of implementation, so it should be developed to include the government's policies in various aspects.
