디지털콘텐츠란 우리가 일상생활 속에서 항상 시청하는 텔레비전방송, 음원, 영화, 컴퓨터 소프트웨어등 어느덧 일상생활 속에 깊게 차지하고 있는 것들이다. 종래 신문, 레코드,영화 등과 같이 종래 아날로그방식으로 제작되고 거래되었던 콘텐츠가 인터넷신문, 음원(MP3), 인터넷 극장 또는 VOD서비스 등과 같은 디지털방식으로 생성․제작되고 온․오프라인등 다변화된 방식의 거래가 일반화 되고 있다. 이처럼 오늘날에 이르러 디지털콘텐츠의 거래가 일반화 되고 있음에 비추어 계약법적인연구는 그에 미치지 못하고 있다. 그 동안 디지털콘텐츠 거래의 법적 성질에 관한 활발한논의에도 불구하고, 디지털콘텐츠 거래의 법적 성질이 무엇인가에 대한 통설이 정립되어있지 않다. 디지털콘텐츠에 관해 직접규율하고 있는 법으로는 콘텐츠산업 진흥법이 있으나, 산업진흥을 위한 기본법으로서의 역할을 하는 것이며, 거래관계에서의 법적효과를 규율하고 있는 것은 아니다. 또한 법적인 연구는 정보통신망의 이용 및 규제 그리고 개인정보등과 관련된 공법적인 연구가 주를 이루고 있다. 디지털콘텐츠 거래의 증가추세는 우리나라에서 뿐만 아니라 유럽연합에서도 최근 가파른 신장세를 보이고 있다. 유럽연합의 유럽위원회(European Commision)는 2019년 1월 29일, 유럽의회와 이사회는 역내시장에서 디지털콘텐츠 및 디지털서비스 공급을 위한 계약의사법 측면을 규제하는 동 지침에 대한 유럽위원회의 제안에 대한 잠정 합의에 도달했다. EU디지털콘텐츠지침의 내용을 중심으로 하는 유럽연합에서의 디지털콘텐츠 거래를 규율하는 법체계와 디지털콘텐츠 및 디지털서비스의 공급에 있어서 합치성의 문제에 관한법적 쟁점에 대하여 살펴보고자 한다.
Abstract
Digital content refers to content produced in digital format such as televisionbroadcasting, sound sources, movies, and computer software that are regularly consumedin people’s daily lives. In the past, contents such as those of newspapers, records, and movies were producedand traded in the conventional analog way. Today, however, digital newspapers such asInternet newspapers, music sources (MP3), Internet theaters, or VOD services are createdand produced, while online and ofline transactions are common. The increase in digital content transactions has ben growing rapidly in Korea, as welas in the European Union. The European Commision of the European Union establisheda directive on certain aspects concerning contracts for the suply of digital content anddigital services in the regional market on January 29, 2019. This directive governs privatelegal relationships regarding the trading of digital content and digital services within theEuropean Union. This study loks at the legal isues governing digital content transactions in the European Union, centered on the content of the EU Digital Contents Directive, and legalisues on the suitabilty in the suply of digital contents and digital services.
