「스마트도시 조성 및 산업진흥 등에관한 법률」의 개선방안에관한 연구

초록
다양한 도시 문제를 해결하기 위해 전 세계가 적극적으로 스마트도시 정책을 추진하고 있다. 싱가포르, 캐나다, 중국 등 많은 국가들이 도시혁신의 방향과 국가경쟁력 강화를 위한 전략으로 스마트도시들을 적극적으로 개발하고 있는 상황이다. 우리나라에서도 스마트도시 활성화를 위해 기존 「유비쿼터스도시의 건설 등에 관한 법률」을 개정하여 「스마트도시 조성 및 산업진흥 등에관한 법률」을 시행 중에 있다. 스마트시티 추진전략을 수립하면서 도시재생뉴딜사업, 스마트도시 통합플랫폼 구축사업, 국가시범도시 지정 등 많은 예산이 투입되기도 하였다. 그러나 이러한 많은 노력에도 불구하고 일반인들에게와 닿는 법⋅제도의 실질적인 성과는 크지 않다. 2018년에 「유비쿼터스도시의 건설 등에 관한 법률」이 「스마트도시 조성 및산업진흥 등에 관한 법률」으로 개정되면서 개념의 모호성과 지원 범위 제약등의 많은 문제를 해결하였으나, 여전히 인프라 중심의 지원과 서비스 제공을위한 개인정보보호법과의 충돌 등은 해결해야하는 과제로 제시되고 있다. 특히 개정된 「스마트도시법」이 기존 법률의 한계점을 그대로 계승하고 있는 상황으로 법의 방향성이나 체계, 기타 법률들과의 관계 등에 대한 문제는 여전히 논의되어야하는 사안이다. 이에 본 연구에서는 최근 개정된 「스마트도시법」을 중심으로 스마트도시정책추진 기반을 강화할 수 있는 법률적 개선방안에 대해 논의한다. 기존 연구들이 스마트도시 활성화를 위해 개별 사안에 대한 내용을 중심으로 논의했다면 이 연구는 「스마트도시법」이 진흥법적 차원에서 법적 안정성을 확보할수 있도록 거시적인 관점에서 해당 법률을 분석한다. 본 연구는 향후 스마트도시 정책이 유비쿼터스도시의 실패를 답습하지 않고 보다 효과적으로 추진될수 있는 새로운 법적 개선방안을 제시한다는 점에서 의의가 있다.
Abstract
The world is actively pushing ahead with smart city policies to solve variousurban problems. Many countries, such as Singapore, Canada, and China, are activelydeveloping smart cities as a strategy for urban innovation and strengthening nationalcompetitiveness. In Korea, the existing “Act on the construction, etc. of ubiquitouscities” was amended to revitalize the smart city, and the “Act on the promotion ofsmart city development and industry” has been implemented. While conducting asmart city implementation strategy, a lot of budgets were invested into projects, suchas the urban regeneration new deal project, the smart city integration platformproject, and the designation of a national pilot city. However, despite these efforts,the actual performance of the legal and political support reaching the general publicis not enough. In 2018, the “Act on the construction, etc. of ubiquitous cities” was revised to the“Act on the promotion of smart city development and industry,’” solving manyproblems such as ambiguity of concepts and restrictions on the scope of support, butConflicts with the personal information protection act and infrastructure-orientedsupport for service provision are still being discussed as challenges to be solved. Inparticular, as the revised “Act on the promotion of smart city development andindustry” inherits the limitations of the previous act, the direction of the law, thesystem, and the relations with other acts are still issues to be discussed. Accordingly, this study discusses legal improvement ways that strengthen thefoundation for smart city policy, with the focus on the recently revised the act. While existing studies have discussed the specific legal issues for activation of smartcities, this study analyzes the laws from a macroscopic perspective for securing legalstability as a promotion act. This study is meaningful in that it proposes new legalimprovement ways that can push ahead more effectively without following the failureof ubiquitous cities.
