어린이집 운영 관련 판례 분석

This study aims to examine the status of court precedents related to the operation of child care centers and analyze the case contents and rulings. For this, 53 court precedents involving child care centers, which are open to the public through the websites of ‘Supreme Court General Law Information’ and ‘Court Library Case Search’, were observed for the period from 2011 to 2019. The results are as follows. First, the number of court precedents involving child care centers reached 5.8 on a yearly basis with the highest amounting to 10 in 2014 and 2015, respectively. Second, the cases were analyzed into four types: child abuse, safety, administrative management and teaching staff. Among them, child abuse had the largest number of court precedents. Third, in terms of trial types, there were 29 criminal trials followed by 21 civil trials and three administrative trials. Fourth, from the point of ruling, punishment was imposed according to the Criminal Act, the Child Welfare Act, the Child Welfare Act and the Infant Care Act. Ruling were also made as a cancellation or change on a prior improper administrative disposition. It is expected that these results can be used as a basis for encouraging childcare workers to take more responsibility, exploring more options for legitimate operation, and providing further support of for child care centers.
