공정거래위원회 현장조사의 범위와 한계에 관한 고찰 - 조사공문의 조사목적 및 조사대상을 중심으로

공정위 현장조사에서 조사공무원이 피조사인에게 교부하는 조사공문은 당해 현장조사의 범위와 한계를 일차적으로 정하는 기능을 갖는다. 특히 조사공문에 기재되는 내용 중 조사대상과 조사목적은 그 핵심이 된다. 그러나 현행 공정거래법 및 공정위 규칙에서 조사대상과 조사목적의 내용이 지나치게 넓게 규정되어 있고, 이것이 실무상으로는 피조사인의 방어권 보장을 어렵게 한다는 문제가 지속적으로 제기되고 있어 검토를 요한다. 본고는 조사공문의 조사대상과 조사목적을 중심으로 공정위 현장조사의 한계와 범위의 현 상황을 진단하고 개선방안을 제시하는 것을 목적으로 한다. 보다 구체적으로는 공정위 조사공문의 내용에 관한 관련 규정을 정리하고 규범적ㆍ실무적 차원의 문제점을 검토하였다. 특히 당해 쟁점과 관련하여 유럽(EU) 법원의 넥상스(Nexans) 사건을 비교법적으로 고찰하였다. 유럽집행위원회의 정식조사 결정에 관한 불복사건인 당해 판례를 통해 조사범위를 정하는 것의 궁극적 목적, 조사대상과 조사목적이 얼마나 구체적이어야 하는가에 대한 정도의 문제, 그리고 경쟁당국의 조사를 불복할 수 있는 제도의 도입가능성에 대해 탐구하였다. 결론적으로 공정위의 현장조사공문의 조사목적으로는 관련 법조항과 사건명 또는 사건번호를 적시하고, 조사대상으로는 조사가 이루어질 상품의 범위 및 지역적 범위 등을 명시해야 한다는 개선방안을 제시하였다. 나아가 문제되는 현장조사가 어떤 법위반유형을 대상으로 하는 것인지 또한 고려될 필요가 있음을 강조하고, 현장조사절차의 궁극적인 합리화를 위해서는 공정위 조사에 대한 사법심사 가능성이 검토되어야 한다는 장기적인 과제까지 제시해보았다.
Abstract
This study aims for defining the scope and limit of the inspection power on dawn raids of Korean Fair Trade Commission – the antitrust authority of Republic of Korea, hereafter ‘KFTC’. Basically the KFTC has a widespread discretion on the investigation procedure, but in concrete cases the discretion has to be limited in a reasonable level through the so-called ‘inspection official paper’. However, according to the current rule and practice the content of the paper - especially the object and the subject of the inspection - is because of its vagueness and broadness irrelevant. To seek an improvement, this study refer to the Nexans Case of EU Competition Law, which shows clues about what the substance which the paper has to cover and how the concrete meaning of the object and subject of inspection has to be defined. In conclusion, the KFTC’s investigation official paper has to be improved in two ways: Firstly, emphazise the balanced function of the paper and secondly, definitize the scope and limit by specifying the case name or number and the product and region of the investigation in a detailed shape on dawn raids.
