통일헌법의 한국정치사상적 기초 모색

초록
이 땅의 만민과 만물의 선순환적 생명활동은 ‘좋지 않은 문제 해결’을 ‘최소 조건’으로 그리고 ‘좋은 주제 실현’을 ‘최적 조건’으로 요구한다. 근현대 서구의 헌법과 법제는 이러한 선순환적인 생명활동을 일정 기간 잘 돕고 지탱해왔다. 그러나 지금도 잘 하고 있다고 말하기 어렵다. 기존 헌법과 법제는 이 시대에 들어서 공적문제 해결에 도움이 되기보다는 오히려 좌우 정치철학의 방법적 양극화와 대립에 의해 가로막혀 공적문제에 제대로 접근조차 못하고 있다. 남북통일을 위한 새로운 통일헌법 논의를 계기로 남북분단 문제와 좌우대립 문제 등의 저변에 깔려 있는 좌우 정치사상의 공통된 치명적 결함을 분명하게 확인하고 그것으로부터 자유로워질 필요가 있다. 그렇지 않고서는 통일헌법을 제대로 마련할 수 없을 것이기 때문이다. 선순환적인 생명활동은 수많은 분업과 협업을 통해 진행된다. 헌법과 법제도 마찬가지다. 여러 분업 중에 하나다. 선순환적으로 생명활동 하는 수많은 분업과 협업을 헌법과 법제 차원에서 돕고 지탱할 수 있도록 ‘통일헌법의 한국정치사상적 기초’를 모색하는 데 이 글의 목적이 있다. 이를 위해 이 글은 먼저 통일헌법에 관한 기존 세 가지 주요 쟁점과 정치사상적 기초에는 오직 지배 방법을 놓고 벌이는 보수와 혁신 정치진영 및 좌파와 우파 정치철학의 ‘방법적 양극화와 대립’ 문제가 놓여 있다는 것을 밝힌다. 기존 진영논리와 정치철학에 내재하는 이러한 공통된 치명적 결함을 밝힘으로써 통일헌법 논의가 기존의 ‘낡은 지배의 논리와 철학’으로부터 자유로워질 수 있도록 돕는다.
Abstract
The virtuous circulatible life activities of all the people and all the things on this land demand ‘bad problems resolution’ as ‘a minimum condition’ and ‘good subjects realization’ as ‘an optimal condition’. The purpose of this article is to search ‘the basis for the unification constitution of the two koreas from the backdrop of korean political thought’ which assist and prop up these virtuous circulatible life activities especially in terms of law and institutions. This article is to reveal that in the existing three main issues and the basis of political thought on the unification constitution lie ‘the methodological polarization and confrontation’ between conservative and innovative political camps and left-wing and right-wing political philosophies only over how to rule. This paper is to help and prop up the discussions on the unification constitution free from ‘the old logic and philosophies only for ruling’ by finding out the common fatal defects inherent in the existing two main political camp’s logic and political philosophies.
