코로나19 사태와 체육시설 정책·제도 현안 분석 ‘체육시설의 설치·이용에 관한 법률 제10조’를 중심으로

The purpose of this study to find the pending issue of the policy and the law for sports facilities, especially in COVID-19 pandemic. The research is mainly focus on ‘The law of installation and utilization of sports facilities No.10.’ The ‘No.10.’ is not reflect social culture, sports market, and the public clamor but it hangs onto the past administrative opportunism. ‘No.10’, the irrational law causing the administrative confusion, social conflict, unfairness in administration and market, and also the legal dispute. ‘The law of installation and utilization of sports facilities No.10.’ is need revision to prevent the social losses and to develop Korean society and sports industry. For this, the first, the government try to revision ‘No.10.’ It has contained social trend and public demands with changing attitude for sports. The second, it need to converging construction space concept with activity type based on develop technology and engineering. The third, it need to refined distinction of the classification with it include new type physical activity and service of sports market. Finally, it must be standing on the needs of consumer, not provider sides as like administrative officer or National Assembly in whole processes the revision of law ‘No.10’.
