빅데이터 시대의 교양교육으로서의 헌법교육

4차 산업혁명이 대학교육에 던진 새로운 개념은 플랫폼으로서의 대학교육이다. 플랫폼이란 서로 다른 영역들이 융합을 이룰 수 있는 토대를 의미한다. 그 플랫폼은 교양교육이어야 한다. 대학의 교양교육은 지식융합 능력과 창의적 문제해결능력을 함양하는 것을 목적으로 한다. 대학의 교양교육은 자기결정권을 지닌 창의적이고 성숙한 개체로서의 개인을 양성하고자 하는 것이다. 교양교육이 상정하는 인간은 헌법재판소가 정의한 헌법상의 인간 개념과 일치한다. 헌법교육이 교양교육이어야 함을 주장하는중요한 근거이다. 헌법교양수업에서는 헌법이 보장하고 개발토록 하는 개인의 역량과 그러한 헌법의 명을 받은 정부가 최소한 충족시켜야 할 최저수준에 대한 논의를 Big Question 방식으로 진행하는 것이 교양교육의 취지에 맞을 것이다. Big Question 방식은 해답을 찾기 위해 개인적 차원을넘어선 다양한 분야의 지식들을 융합하는 과정이 필요하게 만드는데, 이러한 문제해결 과정을 만들어냄에 있어서 Big Question은 일종의 지식확장플랫폼 기능을 수행한다. Big Question에 대한 답을 찾기 위해 학생들이 사용해야 하는 정보의 규모가 빅데이터 수준이어야 한다. 그렇기 때문에 헌법교양교육이 빅데이터의 도움을 받는 것이 필요하다고 주장하는 것이다. 헌법교양교육에 빅데이터를 활용하는 것은 빅데이터가 제공하는 편리함과 유용성을 향유하는 것이다. 그러나 빅데이터와 인공지능이 발달할수록인공지능의 탁월한 데이터 분석 능력과 분석을 종합하는 능력에 매료되어법적 추론까지 인공지능에 의존하는 단계에 이를 수 있다. 빅데이터와 인공지능에 대한 의존보다 더 위험한 것은 교육과정에서 교수와 학생들의개인 정보들이 수업에 활용되는 인공지능에 의해 데이터화되어, 정보의주체가 통제할 수 없는 영역에서 빅데이터의 한 부분으로 흡수될 수도 있다는 것이다. 따라서 빅데이터와 인공지능을 수업에 활용할 때는 반드시정보주체와 관련된 정보들의 삭제 및 확산방지를 요구할 권리인 ‘잊힐 권리(Right to be Forgotten)’가 확보되는 시스템 환경이 보장되어야 한다.
Abstract
A new message that the Fourth Revolution throws on the college education is the high education as a platform. The platform means a foundation where various areas converge. Liberal arts education should function as the platform. Liberal arts education intends to help college students develop their capabilities to conflate knowledges and to creatively solve problems. The purpose of liberal arts education is to nourish an individual to grow as an agent having the power of self-determination, which the Korean Constitutional Court defines a human being to be. In this sense, constitutional education should be major one of liberal arts education. An appropriate way to manage constitutional education as a liberal arts education is to use the method of Big Question in the classroom. The method of Big Question requires various areas of knowledges converge to solve problems. In this process the method of Big Question plays a role as a platform to expand knowledges. Big Data is needed to manage classes with the method of Big Question. To utilize Big Data, a help of Artificial Intelligence is needed. Allowing Artificial Intelligence to participate in the class of constitutional education as a liberal arts education cause other participants such as professors and college students to enhance their reliance on the Artificial Intelligence and may lead to their subordination to control of the Artificial Intelligence. Some safety devices are needed to prevent the problem from happening.
