개발제한구역 내 생활체육시설 설치를 위한법제도 개선방안

주5일제 등 여가문화 확산과 체육활동에 대한 수요 증가 등으로 체육시설 등 인프라에 대한 수요가 증가하고 있다. 최근 정부에서도 생활SOC 정책 추진에 따라 지역 내 소규모 체육시설 등 인프라 구축을 통하여 “국민 누구나 어디에서나 품격 있는 삶을 살 수 있는 대한민국”이라는 비전을 달성하고자 한다. 특히, 공공 체육 기반시설 확충을 통해 10분 내에 체육시설 이용이 가능하도록 실내체육관을 3.4만 명당 1개소 수준으로 확충하는 등 공공체육 인프라 확대를 통하여 활기차고 품격 있는 삶터의 제공을 통해 국민의 삶의 질 향상을 도모하고 있다. 이를 위해서는 체육시설이 설치될 수 있는 부지확보가 필요하나 도시지역에서는 확보가 어려워 공공체육시설 기반 확충에 애로가 있다. 따라서 상대적으로 부지확보가 용이한 개발제한구역 내 공공 체육시설의 설치를 모색해 볼 수 있으나 개발제한구역은 「개발제한구역의 지정 및 관리에 관한 특별조치법」 에 따라 시설 입지가 엄격하게 관리되고 있다. 현재도 개발제한구역 내 체육시설의 설치는 가능하나 해당 지자체장의 허가를 받아 체육시설 중 실외체육시설만 한정적으로 설치할 수 있고 지역주민들의 수요가 많은 다목적 실내체육관 등은 설치가 불가하다. 이 논문에서는 「개발제한구역의 지정 및 관리에 관한 특별조치법」 및 시행령 등을 종합적으로 검토･분석하여 개발제한구역제도 개선을 위한 발전적 방향 모색을 통해 국민의 대표 여가시설인 생활체육시설의 확충에 기여하고자 한다.
Abstract
The demand for sports facilities is increasing due to the spread of leisure culture with five-day workweek and growing sports activities. In accordance with the recent implementation of the SOC policy, the government is trying to achieve the vision of “a Republic of Korea where all citizens can live a dignified life everywhere” by building infrastructure such as small and local sports facilities. In particular, through the expansion of public sports infrastructure, indoor gymnasiums swelled to one per 34,000 people within 10 minutes reach; and increase of public sports infrastructure enabled vibrant and elegant living spaces. Along the process, however, difficulties arose in constructing sports facilities especially in densely populated area. There seemed possibilities of putting up sports sites in restricted development zones where sufficient spots are procured, those places, yet at the same time, are strictly managed under the 「Special Measures Act on Designation and Management of Development Restricted Areas」. Currently, it is available only to build outdoor sports facilities in the area with permission of relevant authorities. To put it simply, multi-purpose indoor gyms - which are in high demand - can be hardly built under current structure. This study concludes with three arguments by seeking developmental directions with comprehensive review and analysis of the 「Special Measures Act on Designation and Management of Development Restricted Areas」: supporting and preserving expenditure for sports spots in restricted-development areas and projecting flexible law operation.
