Improvement Issues of Labor Law for Workplace Democracy

초록

Workplace democracy is often referred to as the theoretical background of the worker’s Participation in Management, and is linked to various ideological and theoretical traditions. Workplace democracy means that workers' participation in the workplace and democracy solve the problem of alienation, guarantee workers' rights, develop better civic consciousness, provide a means of change to another human society, and workers have the right to speak out about business operations through democratic means. The constitutional foundation of workplace democracy can be found in the economic democracy of Article 119 (2) of the Constitution, the right to work under Article 32 of the Constitution, and The fundamental rights of labor under Article 33 of the Constitution. In the various provisions of the Trade Union and Labour Relations Adjustment Act, the Labor Standards Act, the Act on the Promotion of Worker Participation and Cooperation and laws against discrimination in employment, important legal grounds for workplace democracy can be found in the aspects of realizing participatory labor-management relations, eliminating violence and discrimination against workers and human rights. In order to realize workplace democracy, there are a number of issues that need to be improved in the current labor laws. Based on the democratic and independent participation of workers, improvement should be made in the direction of guaranteeing a working environment and working conditions for human dignity.
