지방자치단체에서의 스마트도시 조성ㆍ확산을 위한 법적과제

The era of the fourth industrial revolution involves an irreversible changes in times and one of the most important fields for responding to the industrial and social changes resulting from the foregoing is the Smart City. The number of local governments promoting government-supported smart city projects has been increasing, the number of local governments securing dedicated organizations such as smart city departments and teams has been also rapidly increasing recently, and the types of smart services and projects have been diversified. Whereas the smart city projects for national model cities at the level of the central government have been forming the cities after quite a few of related institutional and legal problems were solved through several amendments to related laws, not all local governments are participating in the smart city projects and related projects for individual local governments because various circumstances are not the same among the local governments. Even those local governments that are participating in and implementing smart city projects have difficulties in efficiently forming and expanding smart cities because many problems are lying scattered in promoting the projects such as collision with other laws and regulation in concrete situations in the implementation of public offering projects, the issue of authorities, information sharing, and the bearing of responsibility for the possibility of failure in the case of early introduction of smart city technologies by local governments. In the case of smart city-related projects, although technical support is essential and important, the preparation of a legal and institutional foundation is also important as much as the foregoing. The difficulties actually experienced or expected by individual local governments while they implement smart city projects should be reviewed in terms of laws and institutions, and based on the results, necessary laws and institutions should be concretized and supported through legislation and reorganization. Although the derivation of the outcomes of the pilot cities is important, the preparation of detailed policies to accelerate the smartization of the existing cities is also necessary, and the legal study that must be resolved for the implementation of smart city projects should be reviewed to derive practical and efficient measures.
