난민인정을 위한 ‘충분한 근거가 있는 공포’의 개념과 증명의 정도에 관한 고찰

초록
난민법 제2조 제1호는 난민의 지위를 인정하기 위한 요건으로 박해를 받을 ‘충분한 근거가 있는 공포’를 요구하고 있고, 이는 난민지위의 인정 여부를 판단하는 가장 중요한 요소이다. 충분한 근거가 있는 공포의 의미에 관한 전통적 접근은 난민신청자가 느끼는 주관적인 감정으로서 공포감과 그러한 감정이 객관적인 상황에 의해 뒷받침되어야 한다는 입장에서 주관적 요건과 객관적 요건을 중첩적으로 요구하여 왔다. 이에 대하여는 난민신청자의 주관적인 심리상태와 공포감을 파악하는 것은 사실상 불가능하므로 주관적 요건은 필요하지 않고 장래발생할 위험에 대한 예측의 의미로서 객관적인 측면에서 충분한 근거가 있는 공포를 파악해야 한다는 비판이 있다. 박해를 받을 위험에 처한 이들에게 국제적인 공동체의 보호를 제공하는 난민협약의 목적과 미래에 대한 예측의 측면을 포함하는 ‘공포’의 문언적 의미를 고려할 때 충분한 근거가 있는 공포를 장래발생할 위험에 대한 예측의 측면에서 객관적으로 파악하는 시도는 타당하다. 구체적인 사건에서 ‘충분한 근거가 있는 공포’ 그 자체가 난민지위 인정을 위한 증명의 대상이 되는 주요사실에 해당하고 난민신청자의 주관적 요소 및 객관적 요소는 위와 같은 주요사실을 인정하기 위한 간접사실로 다루어질 수 있을 것이다. 나아가 이러한 간접사실을 종합하여 난민신청자가 박해를 받을 합리적이 가능성이 있다고 인정되는 경우에는 충분한 근거가 있는 공포가 증명되었다고 볼 수 있다. 지금까지 한국 판례는 충분한 근거가 있는 공포의 개념 및 요건에 대하여 명시적으로 판시를 한 바 없다. 다만 난민신청자에게 주관적인 공포감이 인정되지 않는다는 이유만으로 난민지위를 인정하지 않은 사례는 확인되지 않으며, 충분한 근거가 있는 공포를 인정하기 위한 간접사실로서 주관적 요소와 객관적 요소를 종합적으로 고려하는 입장으로 판례를 이해할 수 있을 것이다. 향후 다양한 유형의 사건이 축적됨에 따라 충분한 근거가 있는 공포의 개념과 이를 인정하기 위한 요건 등에 대한 논의가 이어질 수 있기를 기대한다.
Abstract
The article 2 (1) of the Refugee Act calls for a ‘Well-Founded Fear’ of being persecuted as a requirement to recognize refugee status, which is the most important factor in determining whether refugee status is recognized. The traditional approach to the meaning of well-founded fear requires both subjective and objective requirements; a refugee applicant need to prove that he has a subjective emotion of fear and such feelings should be supported by objective circumstances. In this regard, since it is virtually impossible to determine the subjective emotional state, there is criticism that the subjective requirement is not necessary and that the fear should be identified with sufficient grounds in objective terms as the meaning of predicting future risks. Considering the purpose of the Refugee Convention and the literal meaning of fear, which includes aspects of forecasting for the future, an attempt to objectively grasp the well-founded fear in terms of forecasting the future is reasonable. In specific cases, ‘well-founded fear’ itself is a major fact to be proven to recognize refugee status, and the subjective and objective elements of refugee applicants may be treated as indirect facts to acknowledge the above major facts. Furthermore, if a refugee applicant can establish that there is reasonable possibility of being persecuted by considering indirect facts, a well-founded fear would be considered as exist. The Supreme Court of Korea has never explicitly expressed a judgment on the concept and requirements of well-founded fear. However, it is not confirmed that the refugee status was not recognized just because the subjective fear of the refugee applicant is not exist. Also, the cases may be understood by considering the subjective and objective factors comprehensively as indirect facts to acknowledge the well-founded fear. As various types of cases accumulate in the future, a study on the concept and the requirements of well-founded fear will be followed.
