제3자에 의한 재심의 소에 관한 검토

초록
본 글은 소송을 수계한 파산관재인의 항소 취하에 의한 소송종료, 그리하여 보조참가인이 위 확정판결에 재심의 소를 제기하였는데, 다시 위 파산관재인이 재심의 소를 취하하였고, 이에 따라 결과적으로 법률상 이해관계가 있었던 보조참가인이 나름의 소송상 다툼을 펼치고자 한 것이 난관에 부딪힌 대법원 2015. 10. 29. 선고 2014다13044 판결의 사안에서 비롯한다. 위 사안이 딱 들어맞는 것은 아니지만, 소송 당사자 이외의 제3자라도 확정판결의 효력을 받는 경우나 확정판결에 의하여 확정된 법률관계로부터 반사적으로 영향을 받는 경우에 그 제3자에게도 자신의 권리 내지 법적 이익을 지키기 위하여 원판결을 취소할 기회를 인정할 여지가 있어야 하지 않은가의 점을 생각하기에 이르렀다. 확정판결에 무엇인가 법률상 이해관계가 있는 제3자가 독자적으로 재심의 소를 제기할 수 있는 제도는 이미 대만과 중국 등에서 입법화되었다. 일본에서도 민사소송법 개정과제로 검토되고 있다. 그리하여 본 글에서는 제3자에 의한 재심의 소를 둘러싼 외국의 동향을 살피고, 우리 민사소송법상에서의 시사점을 찾고자 하였다.
Abstract
This study was inspired by Supreme Court Decision 2014Da13044 decided October 29, 2015. The lawsuit was first withdrawn by the trustee in bankruptcy who has taken over the case. Then the intervenor filed a lawsuit for retrial which was later withdrawn again by the trustee in bankruptcy. The situation implies that there’s only so much for an intervenor, as a third party of the lawsuit, in finding a way to solve legal issues by litigation even though he/she has significant legal interest in the result of the lawsuit. The case led to the thought that the third parties also need the opportunity to revoke the judgement in order to protect his/her legal right or interest in cases where he/she might get either direct or indirect impact from the judgement. Specific legal system allowing the third party to file an action for retrial is already enacting in countries such as Taiwan and China. Japan is also taking a close look through the issue for its Civil Procedure Act amendment project. Therefore, this study will search for an useful insight for the current Civil Procedure Act of ours by examining the foreign legal trends around the issue on action for retrial by a third party.
