수사상 영상녹화의 규율방식 및 규율내용 개선방안 - 수사기관의 지침 비교분석 및 상위 법령으로의 통합 제안 -

Since the investigative video recording system was introduced by Criminal Procedure Law in 2007, investigative agencies have applied different rules to the system. There are no concerning clauses in Criminal Investigation Rules in 2020 as ever. It is a question that different rules on the video recording system are fine enough to ignore. In this respect, this study analyzed concerning subordinate statutes of investigative agencies, and explored preceding researches on Criminal Investigation Rules and investigative video recording system, and suggested improvement methods. In chapter 2, the differences of contents and methodology of regulation between subordinate statutes of investigative agencies were identified. Especially, remarkable differences were found in almost every phase of video recording. In chapter 3, the necessity for establishing concerning clauses in Criminal Investigation Rules was identified, and grounds for discussions were constructed. In chapter 4, improvement methods which consist of 26 improvement methods were suggested along with provisions. In the conclusion, implications and limitations of the study were disscussed.
