개인도산절차에 대한 실증조사의 필요성과 방법

지난 20년 동안 개인도산사건은 증감해왔는데, 그 증감의 원인을 분석하는 내용들은 대부분 법령의 개정이나 실무의 변화와 같이 절차 내부의 문제만을 검토하는 연구가 주를 이루었다. 그러나 개인도산절차는 순수한 법률문제 이전에 개인의 경제적 파탄상태라는 경제적인 측면이 요건을 이루고 있으므로, 외부의 경제상황 등 다양한 관점에서 개인도산사건을 분석하는 실증조사가 필요하다. 미국은 오래전부터 다양한 주체에 의하여 실증조사가 실시되었는데, 그 중 가장 유명한 실증조사 중 하나인 Consumer Bankruptcy Project(이하 ‘CBP’라 한다)는 1980년부터 약 10년을 주기로 2010년대까지 지속되고 있고, 그 조사방법에 있어서도 3개 주(州)의 법원기록만을 대상으로 하던 것에서 현재는 50개 주의 법원기록에 더하여 서면질의 및 전화설문까지 실시하는 등 그 수단과 범위가 점차 발전되어 왔다. 그 외에 판사가 실시한 실증조사는 법원에 접수되는 개인도산신청서의 문제점에 대한 분석을, 금융회사가 후원하여 실시한 조사는 채무자들이 개인도산절차를 남용하는지 여부에 대한 분석을 내놓기도 하였다. 미국에서 진행한 다양한 실증조사의 방법론을 참조하여 우리 개인도산사건에 대해서도 전문적인 실증조사가 필요하다. CBP 조사자들이 주장한 바와 같이 회생법원이 경제적으로 아픈 사람을 치료하는 병원의 역할을 하고 있다면, 늘어나거나 줄어드는 환자에게 가장 적절한 치료법을 제시하기 위해서는 병원 내부의 진료방식을 변경하는 것에서 더 나아가, 지역사회 전체의 건강이 악화되었는지를 살피는 것이 현명한 연구자의 책무일 것이다.
Abstract
Over the past 20 years, consumer bankruptcy cases have been increased or decreased over a certain period of time, and most of the analysis of these phenomena has been mainly focused on studies that review only issues within the procedure, such as revision of laws or changes in practice. However, unlike general trial cases, consumer bankruptcy cases require an economical aspect of the individual's economic failure before pure legal matters, so an empirical research is needed to analyze the consumer bankruptcy cases from various perspectives, including the external economic situation. The CBP, one of the most representative empirical research in the United States, has been continued from 1980 to the present every 10 years, and its method has been gradually developed. The empirical investigation conducted by the judge analyzed the problems of the application, and the study sponsored by a financial company analyzed whether personal bankruptcy procedures were abused. It is necessary to conduct independent and continuous empirical research into Korean consumer bankruptcy cases by referring to the methodology of various empirical investigations conducted in the United States.
