围绕婚姻法中国网络虚拟财产保护的法律问题研究

With the development of internet, virtual properties come out. However, they are distinctive from those traditional properties of civil law. The rising network virtual property plays an increasingly important role in our daily life. People also realize the importance of virtual property. Network virtual property is a kind of electromagnetic data which is born from traditional property and has transaction value in the network. The network virtual property is very different from the traditional property. The scope of the network virtual property is constantly expanding, and the style is constantly diverse, and the resulting disputes are also more complex. The focus of the dispute is from the contradiction between network participants, network operators and software developers, and also gradually expanded to the process of the protection of network virtual property in marriage law. There are more and more disputes about the protection of network virtual properties. The legal issues and solutions involved in these disputes have become a hot topic in the legal field. Due to the relatively backward legislation of network virtual property in China, there is still no consensus on the research and discussion of these problems. This paper proposes solutions and several suggestions for the problems faced by the protection of network virtual properties, drawing on foreign experience. Simultaneously, it is important to improve relative legislation so as to protect virtual properties which can make sure that the net economy can develop o healthily and orderly.
