부동산 등기에 대한 블록체인 기술의 적용 및 법적 쟁점

초록
토지 등록은 단순한 데이터들의 분산원장 등록 시스템과 동일시될 수 없으며, 개인이나 기업에게 있어서도 상당한 자산가치를 가지는 재산에 해당하므로 토지 등록 및 이전과정에 대하여 블록체인시스템이 적용된다면 보다 효율적으로, 부동산 거래 및 부동산 관리에 소요되는 사회적 비용을 줄이는 방식으로 적용될 수 있을 것이다. 현재 세계 각 국에서는 부동산 공부시스템에 블록체인 시스템을 도입하여 스마트 자산으로서의 부동산을 갖추고 블록체인 시스템 상에서 거래가능하도록 준비되고 있다. 블록체인 시스템을 통한 토지 등 부동산 재산권의 보장을 위한 제도적 구조를 전환하기 위하여 해당 선결과제로 1) 현재의 등기부 시스템에 의한 부동산의 권리 표상이 진정성을 담보할 수 있을지에 관한 논의와 2) 블록체인 시스템에 기록되기 전에 해당 거래가 진정성 있게 성립되었는지 확인할 수 있을지 논의가 필요하다. 우리나라 부동산공부 시스템 하에서는 등기 제도와 등록 제도가 구별되어 있고, 상호 보완적 관계로 별도 기록물로 보관되고 있는데, 블록체인 시스템으로 정리된다면 해당 정보의 일원화도 필요할 것으로 보여진다. 더욱이, 토지 등록 분야에서 현재 이용 가능한 기술적 해결책이 주요 블록체인, 즉 보안, 무결성 및 투명성의 장점으로 간주되는 효과를 얻기에 충분하다는 것을 입증해야 하는 전제조건으로, 해당 부동산에 등록되어 있는 정보가 진정한 것인지, 시장참여자는 이를 진정한 것으로 신뢰하고 참여하면 책임지지 않을 수 있는지에 대하여 신뢰할 수 있도록 부동산 등기부의 공신력을 인정할 필요가 있다. 결국 블록체인기술은 부동산 공부시스템의 효율성과 명확성을 향상시키는 도구로 효과적으로 활용될 수 있고, 거래의 효율을 높이는 수단으로서 시간과 거리, 공간의 제약을 넘어서는 스마트 계약에 의한 재산권 거래 및 보장의 초석이 될 수 있다. 우리나라의 경우에는 통일한국에서 북한지역 부동산공부시스템을 준비한다는 측면에서도 의미가 있다. 따라서 토지 등록의 주요 기능에 따라 블록체인 기술이 제공하는 가능성을 활용할 수 있는 최적의 법적, 기술적 방법에 대한 논의를 계속하는 것이 바람직하다.
Abstract
The real estate registration is required to be accurate and quick, and real estate contracts need to be in writing. The real estate registration should reflect the correct transaction, and identities of parties need to be authenticated. The real estate registration cannot be equated with the distributed ledger registration system of simple data. Because real estate is considerably valuable to individuals or businesses, its registration and transfer process are more complex than any other transactions of goods. Therefore, government tries to ensure the safety of transactions through various stages. The real estate registration system would be much more efficient if blockchain technologies are applied in a way that costs related to the management of real estate would be reduced, or that transparency would be secured. Blockchain technologies may be cut out for the real estate registration. They may authenticate identities of the parties through digital signatures based upon an asymmetric encryption. Information uploaded on a block is immutable because blockchain technologies apply the merkle tree system. If someone tries to edit a specific information on the block, he or she needs to edit information stored on more than half of nodes in a P2P network. When blockchain technologies are applied to the real estate registration, it is necessary to change the legal system in order to reflect property rights. Securing the authenticity of the information recorded in the real estate registration requires that genuine information be recorded. Blockchain technologies authenticate not that all information has not been edited at all, but not been edited since it was upload. Therefore, It is desirable that the real estate system through blockchain technologies be finally managed by the real estate registry office. Blockchain technologies can be an effective tool for the real estate registration because they would improve the efficiency of the registration and transactions. They would make it possible to buy and sell real estates without the constraints of time and distance. Therefore, it is desirable to continue to discuss the optimal legal and technical methods to take advantage of blockchain technologies.
