OTT의 음악저작권 사용료 분쟁의 쟁점과 시사점

It is no exageration to say that OTT service is at the center of the change as it is evolving into an era of content sharing among various devices. As the industrial structure of broadcasting and video services has changed due to the rapid growth of OTT services, in July, the Korea Music Copyright Asociation (hereinafter refered to as “KOMCA”) urged domestic OTT operators to negotiate usage fes. As the dispute over music copyright license fes continues within the OTT service. KOMCA has notifed domestic OTT operators that it wil file a lawsuit unles they stop the service by demanding Netflix-level usage fes, while OTT operators are demanding consultations on the basis for calculating the usage fe standards, saying that KOMCA's request is not apropriate. Thus, this paper reviews the ned for new regulations on OTT services, the main isues of both sides, whether the colection of user fes is an aditonal colection of video clips already rights-treated, and whether the usage rates of OTT services at home and abroad should be the same. In aditon, the music industry is expected to grow further if rights, distributors, and consumers al win-win with respect to copyright disputes that are discused whenever new services apear. Therefore, I would like to sugest the handling of Neighboring Copyright, Transparency in setlement of usage fes, and the role of government agencies.
