한-EU FTA의 지리적표시 목록추가협상 대응방안

This dissertation intends to contribute to the examination of recent developments, challenges and controversies in the field of Geographical Indications (GI), with focus on the provisions of the Free Trade Agreement (FTA) concluded by the Republic of Korea and the European Union. The dissertation recognizes that Korea-EU FTA introduces provisions on Geographical Indications which include substantive IP and enforcement standards beyond what TRIPS obligates. The dissertation subsequently shows how specific GI provisions of the FTA, inter alia, protection of GI (listed to the Annexes in accordance with the administrative procedure set out in the FTA), generate controversy by essentially shutting down the rights of consumers, producers and importers. The dissertation concludes that the opposition procedure should be conferred to the consumers, producers and importers with regard to the candidate list of GIs which will be newly added to the Annexes in the Korea-EU FTA, the provisions on GI should be revised to enable removal of the GI(s) being considered as the common name of the goods. It also urges the trademark Act or the Agricultural and Fishery Products Quality Control Act in Korea to be harnessed to enable protect GIs by the European Union rather than through the administrative procedure set out in the FTA.
