최근 플랫폼 노동자에 대한 고용ㆍ산재보험 적용에 관한 요구가 높아지고 있다. 이러한 배경하에서 이 글은 세 가지의 질문을 던졌다. 첫 번째 질문은, 현재 플랫폼 노동자들에게는 고용ㆍ산재보험 적용이 안되는가이다. 두 번째 질문은, 적용이 안되는것이 아니라면 왜 고용ㆍ산재보험 적용에 대한 요구가 있고, 플랫폼 노동자들에 대한고용ㆍ산재보험제도 적용상 어떤 문제가 있는가이다. 마지막 질문은, 이 문제를 해결하기 위해서는 어떤 정책적 대안이 만들어져야 하는가이다. 이 글은 위 3가지 질문을중심으로 플랫폼 노동자의 고용ㆍ산재보험제도에 대하여 말해보고자 한다. 현재 고용ㆍ산재보험제도의 적용대상 확대를 위한 여러 측면에서의 논의가 이루어지고 있다. 위의 질문들을 통해 본고가 내린 결론은 고용ㆍ산재보험제도가 플랫폼 노동자를 포함할 수 있는 사회보험제도로 운용될 수 있기 위해서는 현재의 경계를 넘어야 한다는 것이다. 고용ㆍ산재보험제도의 개편을 논하면서 반드시 기존의 「근로기준법」상 근로자 개념을 전제로 설계된 현행 제도의 틀을 고수하는 경우 변화하는 고용형태에 고용ㆍ산재보험제도가 적절하게 적용되기 어려운 부분들이 많다. 고용ㆍ산재보험제도 개편에 관한 논의는 이 지점에서 출발해야 한다. 고용ㆍ산재보험제도가 확대ㆍ발전하기 위해서 가장 필요한 것은 근로자와 근로자가 아닌 자들을 구분하는 경계를 허무는 일이다.
Abstract
Recently, there has been a growing demand for the application of the employment insurance and the industrial accident insurance to platform workers. In considering that demands, this article asked three questions. The first question is whether the platform workers are not covered by current employment insurance and industrial accident insurance. The second question is why, if not unapplicable, there is a demand for employment insurance and industrial accident insurance coverage expansion and what are the problems with the application of employment insurance and industrial accident insurance system to platform workers. The final question is, what policy alternatives should be created to solve those problems. This article focuses on the above three questions and suggests alternatives.
