「양육비이행확보 및 지원에 관한 법률」상 운전면허제한과 부당결부금지 원칙 ― 미국 연방･주 법원의 실체적 적법절차심사를 중심으로 ―

2020. 6. 9. 국회는 양육비채무 이행강제 목적의 자동차운전 면허정지제도(이하 ‘운전면허제한제도’라고 한다)를 도입하는 내용을 반영하여 「양육비이행확보 및 지원에 관한 법률」(이하 ‘양육비이행법’이라 한다)을 개정하였다(제21조의 3). 효율적인 양육비지급이행을 위하여 필요한 제도가 도입되었다는 점에서 환영할만하다. 그러나 동 제도 도입제안 시부터 난색을 표해오던 관련 행정기관과 학계에서는 “부당결부금지의 원칙” 측면에서 부정적인 입장을 취하는 견해가 적지 않았다. 이에 반해 이미 운전면허제한제도를 오랜기간 시행해 온 미국에서는 목적과 수단 사이의 관련성 여부를 다투는 부당결부금지원칙과 같은 논점에 대한 논의가 없지는 않았으나 그 논의의 강도가 크지 않았다. 이는 당해 제도 도입 훨씬 이전부터 행정법률이 달성하고자 하는 목적과 수단 사이의 관련성에 대한 법원의 판결이 많이 축적되어 있었기 때문이다. 목적과 수단 사이의 관련성 문제는 수정헌법 제14조의 실체적 적법절차(substantive due process) 위반여부로 다루어져 왔다. 그리하여 필자는 우리나라의 양육비이행강제 목적의 운전면허제한제도의 부당결부원칙 관련 위헌 여부를 미국의 사례 및 축적된 이론을 통하여 살펴보고자 한다.
Abstract
On July 9th, 2020, the National Assembly of Korea amended 「act on enforcing and supporting child support payment」 to suspend his or her driving license when non-custodial parent fails to pay the child support. Many people from all walks fo life welcome this amendment, but the concerned administrative agencies and some legal scholars are very against it on the ground of “Koppelungsverbot(which is a German legal term meaning that the ends and the means should be substantially related). The United States has enforced the Child Support Enforcement Program of revoking a driving license of a delinquent debtor for decades but there are only several cases of reviewing the substantial relations between the ends(child support payment) and the means(a driving license reviation). Its federal and state courts have dealt with these substantial relations of ‘the legislative ends and the means’ far before the child support enforcement was adopted. The substantial due process of the 14th amendment is required to consider relations between the ends and the means. Therefore, this paper studies and analyzes the cases of the United States’ federal and state courts in order to suggest the way how relations between the ends of child support payment and it's a driving license suspension should be reviewed by courts and legal scholars of Korea.
