가상 데스크톱 환경(VDI) 압수·수색에 대한 수사실무의 법적 쟁점 연구

With the advancement of technology in modern society, various ways of cloud computing services have become common, and many companies are introducing a cloud computing-based virtual desktop Infrastructure (VDI) for cost reduction and security enhancement. The virtual desktop environment is characterized by a network of separate information storage media, which makes it indistinguishable from ordinary computers with the naked eye.In the process of issuing and executing a confiscation or search warrant on the assumption of a general computer without knowing the computer environment of the arrestee in advance, a new seizure warrant is not issued because it is impossible to distinguish it from a regular computer, and the seizure and search procedure is sometimes challenged by the arrester. It is also necessary to clearly distinguish between seizure and search under the current law, as computers containing digital evidence are to be confiscated and searched.Currently, judges attach some restrictions on confiscation and search procedures for digital evidence in the form of a separate sign called "restrictions on methods of seizure and search," but it is difficult to apply them at all various confiscation sites in the investigation.As a solution to the problems arising from the seizure and search of the virtual desktop environment, this high school proposes legislative and investigative working-level alternatives so that clear seizure and search can be carried out and the defense rights of the oppressed can be exercised.
