선물, 뇌물, 기식의 절합: 「청탁금지법」과 선물의 역-발명

초록
본 논문은 「청탁금지법」이 일반적 선물론을 어떻게 절취하고 수정했는지를 밝히고, 그 이후 등장한 ‘선물과 관련된’ 실천들이 「청탁금지법」이라는 새로운 기반 위에서 ‘또 다른 형태의 선물’을 다시 발명하는과정을 추적하였다. 「청탁금지법」은 선물과 호혜성의 관계에 대한 일반적 가정을 멈추고 미풍양속이라는 이름 하에 가려져 있었던 뇌물과기식의 논리를 전면에 내세웠다. 그에 대한 호의적 평가는 선물관계에내재된 기식관계를 조명했다는 점에 기대고 있다. 반면 선물의 본질적특성상 선물과 뇌물을 명확히 구분할 수 없다는 점이 애초부터 품고있었던 문제점이다. 부정부패를 근절을 그 목표로 설정한 「청탁금지법」은 합법/불법을 나누는 기준 자체를 선물의 액수와 선물을 주고 받을 수 없는 대상으로 변경하였다. 이에 예외영역 바깥에 있는 모든 선물은 잠재적이거나 실질적인 뇌물이 된다. 「청탁금지법」에 의해 선물이 선물로 규정된 후, 「청탁금지법」의 시행과 규칙, 예외규정, 사람들의 반응들이 또 다른 ‘선물’을 만들어낸다. 선물(futures)과 후물(pasts) 그리고 선물의 뒤엉킴이 그것이다. 선물(futures)와 후물은 「청탁금지법」에 의해 만들어진 선물에서 역-발명된 것으로 볼 수 있다. 선물-뇌물-기식의 절합과 선물(gift)-선물(futures)/후물의 등장은 선물론 일반과 구분되는, 당대의 선물론이다.
Abstract
The Improper Solicitation and Graft Act (Anti-Graft Act) is based on the idea of gift as (potential) bribe and parasite instead of reciprocity. This turn is an important reason why this act has been accepted favorably despite of various objection and concerns. The concept of gift, however, is paradoxial by nature, and the diffculty of distinguishing gift from bribe is up in the air in the case of Anti-Graft Act. Anti-Graft Act articulated the ideas of gift, bribe and parasite through the enforcement rules, exception and detailed regulation like the ceilings for dining expenses, gratuities, condolence gifts, and gifts that could be provided for the purpose of facilitating offcial tasks, social activities or traditional events. This study suggests notions of gift as futures and pasts which are reactions opening the gray space has between the proper gift, potential bribe and illegal bribe. Anti-Graft Act made gift signfying potential bribe, denied gift and the notion of gift as a trace. In this context, some people try to give the forbidden gift in the form of futures and pasts. They can be examples of counter-invention of gift against the Anti-Graft Act. The Anti-Graft Act makes the contemporary theory of gift by articulation of conflicting ideas of gift and people’s reactions.
