반영구 메이크업의 법적 개선에 관한 연구

반영구 메이크업은 현대인들의 욕구에 부합되어 각광을 받고 있으며 국내뿐만 아니라 세계적으로 그 수요가 급증하고 있다. 그러나 1992년 대법원이 눈썹 반영구 메이크업의 피해 소송에서 보건위생상 위험을 이유로 반영구 메이크업을 의료행위로 판결한 이후 의료법상 의사가 아닌 자가 시술을 하면 불법이 되었다. 국내에서는 대부분의 반영구 메이크업 시술이 비 의료인에 의해 이루어지고 있어 미용업계와 의료계 사이에서 반영구 메이크업 시술 합법화 논란이 끊이지 않고 있다. 최근 K-Beauty의 영향으로 뷰티·미용 산업 분야가 급속도로 발전하면서 특히 반영구 메이크업 분야가 국내뿐 아니라 해외에서도 각광을 받고 있다. 그럼에도 불구하고 국내에서 반영구 메이크업 합법화 논란이 평행선을 달리고 있다. 미국, 일본, 독일 등 외국의 사례를 보면 전문기술을 갖춘 비 의료인의 시술로 이루어지는 것을 알 수 있다. 이에 우리나라의 미용 발전을 위하여 반영구화장의 법적 개선이 필요하며, 이러한 법 제정에 반영되는 기본적인 사항들에 대한 정의를 위해서는 관련된 의료계, 미용업계, 직접 수요층이 되는 소비자 단체 등이 참여하는 협의체가 구성되어 보건적, 산업적, 환경적, 법률적인 부분들에서의 요구가 충족될 수 있는 합리적인 법 제정 방향이 우선적으로 논의되어야 할 것이다. 의료계에서 제시하는 위생이나 감염, 전염에 대한 문제점은 지속적인 점검과 교육, 그리고 법적 절차를 정착화 시키면 소비자들이 만족하는 반영구 메이크업에 이바지할 것으로 전망된다.
Abstract
Semi-permanent, makeup, beauty methodSemi-permanent makeup is in the spotlight as it meets the needs of modern people, and its demand is increasing not only domestically but also globally. However, since the Supreme Court ruled semi-permanent makeup as a medical practice for reasons of health and hygiene in a lawsuit for the damage of semi-permanent eyebrow makeup in 1992, under the Medical Law, it became illegal if a person other than a doctor performed the procedure. In Korea, most semi-permanent makeup procedures are performed by non-medical personnel, and controversy over legalization of semi-permanent makeup procedures continues between the beauty industry and the medical community. Recently, as the beauty and beauty industry has developed rapidly under the influence of K-Beauty, the semi-permanent makeup field is attracting attention not only in Korea but also overseas. Nevertheless, the controversy over the legalization of semi-permanent makeup runs parallel in Korea. In the case of foreign countries such as the United States, Japan, and Germany, it can be seen that the treatment is performed by a non-medical person with specialized skills. Accordingly, legal improvement of semi-permanent makeup is necessary for the development of beauty in Korea. In order to define the basic matters reflected in the enactment of these laws, a consultative body should be formed in which the related medical field, the beauty industry, and consumer groups that are directly in demand will participate. And the direction of legislative legislation that can satisfy the needs in health, industrial, environmental and legal areas should be discussed first. Problems with hygiene, infection, and infection presented by the medical community are expected to contribute to the development of beauty with semi-permanent makeup that satisfies the public if constant attention, education, and legal procedures are established
