장애인 체육단체 직원의 장애인 비하 발언에 대한 법률적 책임 관계

In the sports in Korea, the rights and interests of the disabled tend to be violated very easily, and a fact, the correct perception of sports for persons with disabilities has not been educated, is understood as a cause. For this reason, discrimination or demeaning behaviors against occur continuously. However, the core problem is that the wrong treatment for the disabled is not a phenomenon that only occurs in places that is not related or by the un-disabled. The purpose of this study is to summarize the relationship of responsibility by approaching and interpreting the relations of criminal responsibility for derogatory remarks made by employees of sports organizations for the disabled based on the actual laws of the Korea. The results are as follows. First, the comments of A to B related to the disabled can be largely defined as actions related to insults and personal information leakage. Second, the comments of A was proved illegal by violating the provisions of the Constitutional Freedom of Expression, the Criminal Law’s Offenses of Insult and Defamation, the Discrimination against Disabilities Act, the provisions on the prohibition of personal information leakage and the prohibition of harassment. Third, the crime of insult against the disabled is established and A is liable for damages to B. It is hoped that this study can serve as the basis for eradicating hate crimes against the disabled in Korea.
