뇌과학에 기초한 형벌이론의 새로운 가능성

초록
종래 국내에서 논의된 형벌이론은 절대주의에 대한 비판과 상대주의에대한 수용이었던 반면, 최근에는 영미를 중심으로 형사철학적 관점에서 전개되는 응보주의와 공리주의의 대립과 그의 다양한 변종이론을 둘러싼 논의가 집중적으로 진행되고 있다. 최근 형법학계에서 회자되는 인공지능이나 뇌과학과의 연결고리를 크게두 가지 접근법으로 분류할 수 있다. 하나는 인공지능 그 자체의 형사책임에 대한 탐구이고, 다른 하나는 뇌과학을 통한 형벌이론의 재구축이다. 본논문은 두 번째 주제에 집중하고 있다. 본 논문에서는 우선 형벌이론의 과거와 현재의 전개과정을 간략하게 정리하고, 뇌과학 내지는 인공지능의 등장을 통한 형벌이론의 변화가능성을 살펴본 뒤, 새로운 형벌이론에 대한예측을 위한 탐색을 진행한다. 종래의 형벌이론이 형법학계에서는 대륙법체계내에서의 절대주의와 상대주의의 대립으로 이해되었고, 윤리이론영역에서는 영미계 전통을 따라응보형이론과 공리주의이론간의 대결구도로 전개되었다. 하지만 뇌과학이론의 발전으로 인간의 자유의사에 대한 판단, 그에 기한 범죄행위에 대한과학적 판단, 나아가 그러한 행위에 대한 양형요소의 축소 등을 내용으로하는 치료적 정의에 기한 형벌이론이 등장함에 따라 양 이론의 새로운 매개점이 마련되었다고 판단된다. 향후 새로운 혼합이론에 대한 활발한 토의를 통해 종래 형법학계 내에 갇혀 있었던 형벌이론을 윤리학, 철학, 의학, 과학과 연계한 학제적 연구의 장으로 가져와 보다 개방된 형벌이론을 새롭게 구축할 필요성이 증대되었다고 판단된다. 본 논문이 제시한 치료적 정의에 기한 형벌이론 구축안이 보다 심층적인 토론과 학제적 연구를 거쳐 우리나라 형사사법 시스템에 적합한 형태로 도입될 수 있길 기대한다.
Abstract
While the theory of punishment, which was discussed in Korea, was mostly criticism of ‘absolutism’ and praise for ‘relativism’, recently, the debate over the confrontation between ‘retributivism’ and ‘utilitarianism’ or ‘consequentialism’ that develops from a criminal philosophy perspective centered on Anglo-Americanism and his various variants has been intensively carried out. The link between artificial intelligence and brain science, which has recently been circulated in criminal law circles, could be largely classified into two approaches. One would be an exploration of the criminal responsibility of artificial intelligence itself and the other would be the rebuilding of the theory of punishment through brain science. This paper concentrates on the second topic. First, we briefly summarize the past and present development of the theory of punishment, examine the possibility of change in the theory of punishment through the emergence of brain science or artificial intelligence, and conduct a search for the prediction of the new theory of punishment. The conventional theory of punishment was understood in criminal law as a confrontation between absolutism and relativism within the continental legal system, and in the area of ethics theory, it developed into a confrontation between the theory of retributivism and utilitarianism in accordance with the Anglo-American tradition. However, as the development of the theory of brain science has led to the emergence of the theory of punishment based on the therapeutic definition of human free will, scientific judgment of criminal behavior due to it, and reduction of modality for such behavior, it is believed that a new medium of both theories has been prepared. Active discussion of the new mixed theory in the future is believed to have increased the need to build a new open theory of punishment by bringing the previously confined penal theory into the field of academic research linked to ethics, philosophy, medicine and science. This proposal to establish the theory of punishment based on the therapeutic definition can be introduced in a form suitable for the criminal justice system after in-depth discussion and further research.
