보조도선사의 법적 책임에 관한 고찰- 대전고법 2018. 9. 5. 선고 2018누10154 판결의 평석을 중심으로 -

초록
도선사는 해상교통의 안전과 항만의 효율적 운영을 도모하기 위해 특정 지역의 수로에 관한 지식과 선박조종능력을 갖춘 자로서, 선박에 승선하여 선박을 안전한 수로로 안내하는 업무를 수행한다. 도선법에서 도선자의 자질·면허의 요건 등에 대해 엄격한 규제를 하고 있음에도 불구하고, 도선사는 도선업무의 수행을 위한 짧은 승선시간 동안 도선업무를 성공적으로 수행해야 함으로 인해 항상 해양사고 발생의 위험에 직면하고 있다. 도선법에 따라 도선사는 원칙적으로 도선사면허 등급에 따라 지정된 선박의 도선만을 하여야 하지만, 2급 이하 도선사면허를 소지한 자라도 1급 도선사면허를 소지한 자와 함께 도선하는 경우에는 지정된 도선대상 선박이 아닌 경우에도 도선을 할 수 있다. 이에 따라 도선사회는 「도선배정지침」을 통해 일정한 경우 도선사면허가 상이한 2인 이상의 도선사의 도선허용 및 도선사 상호 간의 관계 등에 대한 규정을 두고 있다. 그러나 2인 이상의 도선사가 도선을 하는 중에 해양사고가 발생한 경우에 도선사 상호 간의 법률관계, 특히 소위 ‘보조도선사(Co-pilot)’라고 칭하는 자의 해양사고 발생 시의 법적 지위와 책임에 관해서는 도선법 등에 명문규정이 없다. 도선사는 선박소유자와의 도선계약에 따라 도선업무를 수행하는 상업사용인임과 동시에, 도선법에 따라 항만운용의 효율성과 환경보호 등에 이바지해야 할 공익적 의무도 부담하고 있다. 이러한 도선사의 법적 책임은 도선사 각자가 부담하는 것으로서, 보조도선사라고 해서 그 법적 지위가 주도선사와 다르지 않다. 나아가 주도선사와 보조도선사 사이의 업무분장 등에 관한 도선배정지침의 관련 규정은 도선사 내부의 업무분장과 권리의무에 관한 기초가 될 수는 있어도, 도선업무로 인한 해양사고 발생 시 도선사의 법적 책임에 관한 근거가 될 수는 없다. 따라서 2인 이상의 도선사가 공동으로 도선업무를 수행하는 경우, 모든 도선사는 각자가 독립적으로 도선법 등에서 규정하는 권리의무의 주체가 되고, 도선사의 고의 또는 과실로 인해 해양사고가 발생한 경우 도선사는 징계처분의 대상이 된다.
Abstract
In order to promote the safety of maritime traffic and the efficient operation of ports, the pilot is a person who has knowledge of waterways in a specific area and ability to control ships, and is responsible for guiding ships to safe waterways. Despite the strict regulations on the qualifications and license requirements of the pilot, pilots are always faced with the risk of maritime accidents as they have to successfully perform the piloting business during the short embarkation time for conducting the piloting business. According to the Pilotage Act, pilots must, in principle, conduct only ships designated according to the level of the pilot’s license. However, even if a person holding a pilot license of level 2 or lower is allowed to lead a ship with a person who holds a pilot license of level 1, they may lead all ships. Accordingly, the pilot association stipulates the standards for permitting service of two or more pilots with different licenses and the relationship between pilots, etc. However, in the event of a maritime accident while two or more pilots are conducting a ship, there are no express provisions regarding the legal relationship between the pilots, especially the legal status and responsibility of the ‘Co-pilot’. Pilots are commercial servant who perform piloting services in accordance with the piloting contract with the shipowner, and are also responsible for the public interest to contribute to the efficiency of port operation and environmental protection in accordance with the Pilotage Act. The legal responsibilities of these pilots are borne by each pilot, and the legal status of an co-pilot is no different from that of the leading pilot. Furthermore, the relevant provisions of 「the guideline for the assignment of ships」 may be the basis for the division of duties and rights and obligations within the leading pilot and co-pilot, it can not be a legal ground for the division of legal responsibility between them in the event of a maritime accident. Therefore, when two or more pilots jointly conduct the pilotage, all pilots independently become the subject of rights and obligations stipulated in the Pilotage Act. Additionally, if a marine accident occurs due to the pilot’s intention or negligence, each pilot is subject to disciplinary action.
