상업용 수상무인선박과 규제법제 개선방안에 관한 연구

초록
정보통신 및 인공지능 관련 기술의 급격한 발전에 따라 조만간 무인선박이 상용화될 것으로 보인다. 그러나 무인선박의 기술적 개발에 못지않게 중요한 점은 무인선박의 상용화를 뒷받침할 법제의 정비라고 할 수 있다. 선박의 운항은 항시적으로 인적․물적 손해발생의 개연성을 내포하고 있음으로 인해 전 세계적으로 선박안전과 해양환경보호에 관한 촘촘한 규범질서를 형성하고 있다. 이러한 해사규범질서는 거의 대부분 강행규정화 되어 있음으로 인해, 해당 해사규범이 요구하는 조건 등을 충족하지 못하는 선박은 운항 자체가 불가능하다. 그런데 무인선박은 유사 이래로 해사안전의 핵심 전제였던 선원이 승무하지 않는다는 점으로 인해 기존 해사안전 관련 규범체계와 긴장관계를 형성할 소지가 있고, 기존 해사안전 관련 법규의 정비가 적시에 이루어지지 않을 경우, 무인선박의 운항이 불가능할 소지도 있다. 따라서 무인선박의 상용화를 위한 규제법규의 개선을 위한 국내법 차원의 정비작업이 시급하고, 이러한 작업의 결과물은 향후 국제해사기구 등에서의 규제법규 정비과정에서 우리의 기준을 관철할 수 있는 큰 자산이 될 것이다. 한편 무인선박의 출현은 단순한 새로운 형태의 운송수단의 출현을 넘어, 간단치 않은 사회․경제적 영향을 미칠 것이다. 그러나 기술의 발전과 산업구조의 변화에 적절히 적응하지 못하는 경우 그 결과는 관련 산업전반의 퇴보와 함께 경제적 취약계층의 양산을 불러올 수 있다. 무인선박의 상용화로 인한 여러 난제들에 대해서는 국가 차원에서 노사가 함께 풀어나가야 할 정책과제라고 할 수 있다. 따라서 정부는 무인선박의 개발 및 상용화의 추진과 함께 새롭게 나타날 무인선박 관련 새로운 일자리
Abstract
With the rapid development of Information and Communication Technology and Artificial Intelligence, unmanned ships are expected to be commercialized sooner or later. However, as important as the technological development of unmanned ships is the revision of legislation to support the commercialization of unmanned ships. The operation of vessels always involves the possibility of human and material damages. Accordingly, a close legal system has been formed on ship safety and marine environment protection worldwide. Since most of these maritime law systems are mandated, it is impossible to operate a vessel that does not meet the conditions required by the relevant maritime laws. However, as for unmanned ships, there is a possibility of conflict with the existing maritime safety-related legal system due to the absence of sailors on board, a key premise of maritime safety. Also if the existing maritime safety related laws are not revised in a timely manner, it may be impossible to operate unmanned vessels. Therefore, it is considered urgent to review domestic laws to improve regulatory legal system for the operation of unmanned ships. The result will be a great asset to meet our standards in the process of overhauling regulatory laws and regulations in the future. On the other hand, the emergence of unmanned ships will have a non-simple social and economic impact beyond the emergence of a simple new form of transportation. However, if it is not adequately responded to technological advancements and changes in industrial structure, the result can lead to mass production of economically vulnerable groups along with the regression of the entire related industry. It can be said that the various difficulties caused by the use of unmanned ships are a policy task that labor and management must solve together at the national level. Therefore, the government should properly pursue necessary measures to create new jobs related to unmanned ships and transfer existing crew members along with the development and commercialization of unmanned vessels.
