초록
전승된 사료를 토대로 고전 로마법상 공동해손 법리를 요약하면 다음과 같다. 첫째, 고대 그리스에서 형성・발전된, 공동해손에 관한 로도스 해법은 늦어도 공화정기 말기에 로마법률가들에 의해 일종의 해상관습(법)으로서 로마에 주체적으로 수용되어, 로마 고유의 법 발견과 해석준칙에 기초하여 공동해손의 요건과 효과에 관한 법리가 상당히 정교하게 다듬어졌다. 둘째, 해적이 나포한 선박을 대가를 주고 반환받는 사례와 보트에 옮겨 실은 화물이 보트침몰로 상실된 사례에서 알 수 있듯이, ‘투하’라는 개념이 이미 공화정 말기부터 확대 해석되기 시작했으며, 그리하여 결국 투하는 공동위험을 피하기 위한 희생의 의미를 갖게 되었다. 셋째, 공동위험을 피하기 위한 선박 일부 훼손이나 속구의 탈거도 선주와 화주들이 분담해야 할 공동해손으로 인정된 반면, 자연현상에 의한 의장품 등의 손실은 공동분담의 대상이 되지 않았다. 넷째, 고전법에서 선박보존(‘salva nave’)이 공동해손의 요건으로 확립되었는데, 이르면 공화정 말기에 시작된 것으로 보인다. 다섯째, 공동해손의 요건인 선박과 화물의 보존이 목적항까지 요구되지는 않았지만, 적어도 일정한 장소적・시간적 범위에서 성립해야 했다. 여섯째, 승객의 의복이나 휴대하는 보석도 공동분담 대상 화물에 포함되었으나, 소비목적으로 휴대한 음식은 공동분담 대상에서 제외되었다. 일곱째, 투하와 적하보존 사이에 인과관계에 대해서는 분명한 입장을 알기 어려우나, 해상투하의 특성상 인과관계를 부정하는 측에서 다른 원인(예컨대 해상위험의 갑작스런 중단)이 개입하여 선박과 적하가 보존되었음을 증명해야 했던 것이 아닌가 추측된다. 여덟째, 늦어도 고전시대 후기까지 공동해손분담을 실현하기 위한 수단으로 선장에 대한 도급소권(actio locati)과 선장의 수급소권(actio conducti)이 인정되었다. 공화정 말기 세르비우스(Servius)는 투하로 손실을 본 화주는 선장을 상대로 투하로 보존된 화물을 유치하라고 도급소권으로 소구할 수 있다고 한 반면, 고전시대 후기 파울루스(Paulus)는 유치권 행사가 불가능한 승객을 상대로는 수급소권 이외에 임대소권도 생각해 볼 수 있다는 견해를 피력했다. 선장의 유치권과 임약소권은 선장이 손실을 입은 화주들에 의해 소구당한 것을 요건으로 했는지는 확실치 않다. 아홉째, 변제자력 없는 승객의 분담금에 대해 선장이 책임을 지지 않았으며, 선장은 분담의무자의 재산을 검색할 의무도 없었다. 열째, 선적되어 있던 화물 중 일부의 투하로 인해 그 아래나 옆에 있던 화물이 노출됨으로써 피해를 입은 경우, 고전시대 후기의 칼리스트라투스(Callistratus)는 화물이 훼손된 화주의 분담액이 손해액보다 많은 때에는 그 차액만을 공동분담해야 하나, 반대의 경우에는 오히려 손해액에 대해서 화물을 보존한 다른 화주들에게 공동분담을 요구할 수 있다고 한다. 또한 상실된 화물은 출발항에서의 가액을 기준으로 하고, 보존된 화물은 목적항에서의 가액을 기준으로 한다.
Abstract
The doctrine of general average in classical Roman law can be summarized as follows. First, the Rhodian Sea Law of Jettison, formed and developed in ancient Greece, was voluntarily introduced in Rome as some kind of maritime custom (law) by the end of the republic (Servius) at the latest. The Roman jurists elaborated the doctrine of the requirements and effects of the general average based on their own rules of discovery and interpretation of the law. Second, as can be seen in the case of the pirates of Servius and the case of cargo transshipped into a boat and lost due to shipwrecking, the concept of ‘jettison’ has already begun to be extended from the end of the Republic. At last, the ‘jettison’ came to have the meaning of sacrifice to avoid common danger. Thirdly, while shipowner and shippers had to share the partial damage of the ship and the removal of pieces of equipment to avoid the common danger, the loss of equipment due to natural disaster was not considered to be shared by the shippers whose goods are saved due to the jettison. Fourth, it appears that it began as early as the end of the republic when the classical law established ship conservation (“salva nave”) as a requirement for gross average. Fifth, the conservation of ships and cargo, which is a requirement of the general average, was not required up to the port of destination, but it had to be established at least within a certain place and time range. Sixth, clothes and jewelry carried by passengers were also included in the saved cargo, but the food carried for consumption was excluded from the saved goods. Seventh, it is difficult to know a clear position on the causality between jettison and conservation of ship and cargo. But the characteristics of jettison lead to the supposition that the party which denies the causality had to prove that the ship and cargo were preserved by another cause (for example, sudden interruption of marine danger). Eighth, in classical law, the actio locati and conducti against or the captain were recognized as a means to realize the gross average. According to Servius at the end of the Republican era, the shipper of sacrificed cargo could sue the captain to seize the saved cargos of other shippers, while the last classical jurist Paulus took also the actio locati of the captain into account if the retention right of captain could not be exercised. It is not clear that he should be sued by the shipper who suffered the loss to exercise retention right and the actio locati and conducti. Ninth, the captain was not responsible for the contributions of insolvent shippers, and the captain was not obliged to investigate the property of the obligee. Tenth, the late classical jurist Callistratus decided the case in which some shipped goods were exposed by the jettison of other goods and damaged by seawater according to the following distinction. If the share of cargo is greater than its damage, the amount of difference must be shared. In the opposite case, the damage should be shared by other shippers of saved cargos. Besides, the value of the lost cargo is calculated based on the value at the port of departure, while the value of the saved cargo is based on the value at the port of destination.
